A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE, CALIFORNIA, OPPOSING
PROPOSITION 1, BEHAVIORAL HEALTH SERVICES
PROGRAM AND BOND MEASURE, WHICH HAS
BEEN PLACED ON THE MARCH 5,2024, STATEWIDE
PRESIDENTIAL PRIMARY ELECTION BALLOT
WHEREAS, Governor Gavin Newsom and a majority of the California State Legislature
has placed Proposition 1 —Behavioral Health Services Program and Bond Measure ("Proposition
1")on the March 2024 ballot,which will completely rewrite the intent and flexibility of the Mental
Health Services Act("MHSA"); and
WHEREAS,Proposition 1 seeks to divert funding away from programs typically serviced
through the MHSA while also issuing$6.38 billion in bonds,causing the State to incur significant
debt which the Legislative Analyst Office ("LAO") estimates will cost $310 million in annual
payments over the next 30 years; and
WHEREAS, while also incurring $6.38 billion in debt, plus interest, the proposed ballot
measure also specifies that permanent supportive housing funded through Proposition 1 bond
proceeds may be developed on a "by right" basis undermining local zoning restrictions where
multifamily residential, office,retail, or parking are principally permitted uses; and
WHEREAS, Proposition 1 will divert an estimated $140 million annually away from
counties to the State while also dictating how remaining funds can be used locally,removing local
control, and removing discretion away from local elected officials most familiar with the issues
facing their communities; and
WHEREAS, Proposition 1 is a detrimental proposal that beyond limiting local zoning
authority or diverting funding back to the State,also incurs $6.38 billion in debt while the State of
California faces what the LAO estimates to be a$68 billion deficit; and
WHEREAS, in making these significant sacrifices, the LAO estimates Proposition 1
would"reduce statewide homelessness by only a small amount."
NOW, THEREFORE,the City Council of the City of Orange resolves as follows:
Section 1: The Orange City Council does hereby oppose Proposition 1, Behavioral Health
Services Program and Bond Measure.
Section 2: The City of Orange supports local control and fiscal responsibility and believes
that decisions regarding zoning are best reserved for local elected officials.
Section 3: This resolution shall take effect immediately upon its adoption by the City
Council, and the City Clerk shall certify the vote adopting the resolution.
