A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE SETTING THE AMOUNT OF
APPEAL FEE FOR ADMINISTRATIVE CITATION
APPEALS
WHEREAS, California Government Code Section 53069.4 authorizes the City Council to
adopt an ordinance which makes any violation of the Orange Municipal Code ("OMC") subject to
an administrative fine; and
WHEREAS, on March 28, 2023,the City Council adopted Resolution No. 11444, setting
fines and fees relating to administrative citations, including the administrative citation appeal fee;
and
WHEREAS, on May 9, 2023, the City Council adopted Ordinance No. 04-23 pursuant to
Government Code Section 53069.4, adding Chapter 1.10 to the OMC making specified violations
of the OMC subject to an administrative fine and establishing procedures governing the
imposition, enforcement, collection, and administrative review (appeal) of those administrative
fines; and
WHEREAS, after further discussion, the City Council determined to reduce the
administrative citation appeal fee.
NOW,THEREFORE,BE IT BE RESOLVED by the City Council of the City of Orange
as follows:
1. The Administrative Citation Appeal Fee is reduced from$85 to $50.
2. Said appeal fee shall be required from any person who has been issued an
administrative citation and wishes to appeal said citation before a hearing officer.
3. Said appeal fee shall be refunded if the citation is dismissed upon appeal.
4. This Resolution shall be effective immediately upon the effective date of Ordinance
No. 04-23.
