Public Hearing: 3:00 p.m.
Zoning Administrator (ZA) Pete Goodrich called the Public Hearing to order at 3:00 p.m. and reviewed
meeting procedures.
NEW ITEMS:
(1) Conditional Use Permit No. 3086-19 – Dwyer Residence
A request for a conditional use permit to allow a single-story detached habitable accessory
structure with interior plumbing on an existing single-family residential property.

Vidal Marquez, Assistant Planner, presented a project overview consistent with the Zoning Administrator
Staff Report. He noted this project is not intended to be an Accessory Dwelling Unit (ADU) and should
not be considered as such, although the applicant has the opportunity to apply for ADU status in the
future. Staff has received two phone calls from the public regarding this project: one general
informational question and one concern regarding privacy from surrounding views. Staff stated the
privacy concern is existing due to the site being at a higher elevation above lower properties.
Brett Coombs, project architect, questioned Condition #15 of the Staff Report regarding the requirement
for a fire sprinkler. He asked for an exception to this condition because of the size of the proposed unit.
The ZA responded that, procedurally, the applicant would have to appeal the condition to the Fire
Department. The Conditional Use Permit would then have to be amended and brought back before the
Zoning Administrator.
The ZA opened the public comment portion of the meeting.
There were no speakers.
The ZA closed the public comment portion of the meeting.
The ZA questioned Staff regarding the project site lines.
The ZA rendered a decision and approved Conditional Use Permit No. 3086-19 – Dwyer Residence,
based on the seventeen conditions listed in the Staff Report.

A request for a conditional use permit to allow a single-story detached habitable accessory
structure with interior plumbing on an existing single-family residential property.
Location: 851 North Orange Street

Vidal Marquez, Assistant Planner, presented a project overview consistent with the Zoning Administrator
Staff Report. He noted this project is outside of the historic district so no special design considerations
were taken. The project is intended to be additional guest space and use will be temporary uses only. It is
not to be an Accessory Dwelling Unit (ADU) and should not be considered as such, although the
applicant has the opportunity to apply for ADU status in the future.
The ZA opened the public comment portion of the meeting.
The applicant, Brad Chamberlin, was available to answer questions. He requested the ability to appeal
Condition #15 regarding the requirement for a fire sprinkler with the Fire Department. He asked for an
exception to this condition because of the distance of the structure from his main residence.
The ZA responded that, procedurally, the applicant would have to appeal the condition to the Fire
Department. The Conditional Use Permit would then have to be amended and brought back before the
Zoning Administrator.

The ZA explained the deed restriction to the applicant.
The ZA rendered a decision and approved Conditional Use Permit No. 3082-19 – Chamberlin Residence,
based on the eighteen conditions listed in the Staff Report.
