A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE PROVIDING CONTINUATION
OF WAGE AND BENEFITS TO CITY EMPLOYEES
WHO ARE INVOLUNTARILY CALLED TO ACTIVE
DUTY WITH THE U.S. ARMED FORCES IN
SUPPORT OF OPERATION ENDURING FREEDOM
TO COMBAT TERRORISM AGAINST AMERICA.
WHEREAS, in compliance with California Military and Veteran Code Sec. 395, the
City of Orange grants fully paid leave of absence and continuation of benefits for employees
who artl ordered to report to duty for a maximum of 30 days per calendar year; and
WHEREAS, the normal tour of duty to which a reservist may be ordered without
congressional action is six (6) consecutive months, or with congressional action is twenty-
four 24) consecutive months;
and WHEREAS, a number of employees have been and others may be called to
active duty in connection with actions to combat terrorism against America,
and WHEREAS, the City Council of the City of Orange wishes to alleviate
financial hardships which employees and their dependents will experience as a result of being
called into active duty, during such
crisis.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Orange
that:1. In addition to the full paid military leave provided by California Military
and Veterans Code, Section 395, each employee of the City who has been or is
called to involuntary active military service in cOllilection with the current crisis, shall
be entitled up to another 150 days of military leave with full pay and benefits for
the period of absence on active
duty.2. After the initial 180 days of full pay for Military Leave, if an employee is
required to continuehis/her active duty with the U.S. Armed Forces during the
current crisis, the employee shall be entitled to leave with partial pay pursuant to Section
3 of this Resolution for the period of absence on active
duty.3. The amount of pay each employee shall be entitled to receive from the City for
the additional period of military leave shall be the difference between the gross
pay and allowances actually received by the employee from the United
States Government for such service and the gross wages that said employee would
have received from the City of Orange ifhe or sh(: had not been called to active
military duty, subject to all required and appropriate deductions and
4. The City shall provide continued health and benefits to such employees'
dependents, provided that the dependents were covered for such benefits prior to
the employee being called to active duty.
5. Wage or benefits pursuant to this Resolution are conditioned upon the employee
requesting such payment providing satisfactory proof and documentation
eligibility to receive payment in accordance with procedures established by the
Director of Personnel.
6. The effective date of the Resolution shall be September 11,2001.
