RES-9540 Major Site Plan Review Approval No. 193-01 St. John's Lutheran Church Specific PlanRESOLUTION NO. 9540 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING MITIGATED NEGATIVE DECLARATION NO. 1673-01 AND MAJOR SITE PLAN REVIEW 193-01 FOR THE CONSTRUCTION OF A CLASSROOM AND ADDITION TO THE PRESCHOOL LOCATED WITHIN THE ST. JOHN'S LUTHERAN CHURCH SPECIFIC PLAN.Applicant: St. John's Lutheran Church RECITALS:WHEREAS, Zone Change No. 1209-01 and Major Site Plan Review No, 193-01 were fikd by St John's Lutheran Church in accordancl~ with the provisions of the City of Orange Municipal Code; and WHEREAS, Zone Change No, 1209-01 and Major Site Plan Review No, 193-01 were processed in the time and manner prescribed by state and local law; and WHEREAS, the Planning Commission has considered the information contained in Mitigated Negative Declaration No. 1673- 01, including the initial study and comments received during the public review process, lmd has found that with adoption of mitigation measures to address potential impacts to traffic, noise, air quality, geology and SOIls water quality, and public services, the project will not significantly impact the environment or wildlife; and WHEREAS, on June 27, 2001 the Staff Review Committee reviewed the St John's Lutheran Church Specific Plan and associated Master Pi<m and recommended that the project proceed subject to conditions; and WHEREAS, on April 18,2001, May 2 and 15,2001, July 11, 17 and 25, 2001, the Design Review Committee reviewed the design of the buildings and signage associated with the Specific Plan and Master Plan and on July 25, 2001 recommended that the project proceed subject to conditions; and WHEREAS, the Planning Commission conducted one duly advertised public hearing on August 6, 2001 for the purpose of considering Mitigated Negative Declaration No. 1673-01, Zone: Change 1209-01, and Major Site Plan Shaffers Addition, Block B, Lots 1-13 and 16-18; and, Kogler and Geiger Addition, Block A, Lots 2, 3, and 5 in the City of Orange, California.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Mitigated Negative Declaration No. 1673-01, and Major Site Plan Review No.193-01 for St. John's Lutheran Church campus to accommodate implementation of a Master Plan involving construction of a new 55,500 square foot classroom building and a 3,766 square foot preschool addition based on the following findings:I, Mitigated Negative Declaration No. 1673-01 was prepared in conjunction with Major Site Plan Review No. 193-01. After examining the Initial Study, Mitigated Negative Declaration, and considering all information related thereto the City Council for the City of Orange finds that any potential significant adverse impacts can be mitigated to a level of insignificance. Therefore, the City Council approves and adopts Mitigated Negative Declaration No. 1673-01.2, The project design is compatible with surrounding development and neighborhoods in that the proposed Chapman classroom building and nursery school addition incorporate design elements that respond to the character of the Old Towne Historic District including building materials, fenestration patterns, scale, and massing, The design of the Chapman classroom building consists of a brick and plaster veneer to reflect the predominant building materials utilized on the St. John's campus. It is also stepped at the second story adj acent to the historic Ainsworth House, incorporating a trellis-covered balcony to provide a harmonious transition with that property. The nursery school addition is designed in the Bungalow style to reflect the historically significant building that it is connected to, as well as one of the major residential architectural styles of the surrounding neighborhood.3, The project conforms to City development standards and any applicable special design guidelines or specific plan requirements in that Major Site Plan Review No,193 is one component of the larger development application for Zone Change No,1209, which establishes building development, signage, and parking standards that are unique and tailored to the St. John's Lutheran Church and School campus. The new classroom and preschool buildings have been reviewed by the City's Design Review Committee for conformance with the Old Towne Design Standards.4. The project provides for safe and adequate vehicular and pedestrian circulation, both on- and off-site in that the project increases the amount of parking on the site trom 47 to 83 spaces, creating the ability for more of the site-related The proposed project also includes a Transportation Demand Management Program intended to reduce the amount of traffic and parking demand generated by the St. John's campus. Additionally, mitigation measures and conditions of approval adopted in conjunction with project approval will address traffic congestion and safety-related issues through the establishment of a pick-up/drop-off progranl for the school, and crosswalk safety standards, and the provision of bicycle parking.5. City services are available and adequate to serve the project in that the City's Public Works, Water, Fire, and Police Departments have reviewed the project. The Police Department has indicated that with adoption of the proposed mitigation measures and conditions of approval, impacts to their Traffic Division can be adequately addressed,All other departments indicated that they are ablt: to serve the project subject to their standard development conditions,6, The zone change from Office Professional (OP) and Duplex Residential (R2-6) to Public Institution-Specific Plan (PI-SP) is intended to provide for a master planned expansion of the St. John's Lutheran Church and School campus through an overall floor area ratio of ,55. Therefore, Major Site Plan Review No. 193-01 is bound to,and cannot proceed without, approval of Zone Ch:mge No. 1209-01.HE IT FURTHER RESOLVED that the following conditions are imposed subject to approval of Major Site Plan Review No. 193-01:General I, Within two (2) days of final approval of this project, the applicant shall deliver to the Planning Division a cashier's check payable to the County Clerk in an amount required to fulfill the fee requirements of Fish and Game Code Section 711.4(d)(2) and the County administrative fee" to enable the City to file the Notice of Determination required under Public Resources Code 21152, 14 Cal. Code Regulations 15075. If it is determined that there will be no impact upon wildlife resources, the fee shall be $43,00.2, All construction shall conform in substance and be maintained in general conformance with plans labeled Exhibit A (dated August 6, 2001 for identification purposes) and as recommended for approval by the Planning Commission and ultimately approved by the City Council. Further, exterior building color and materials shall conform with the color and materials board submitted to and approved by the Design Rt,view Committee on July 17, 2001.Any change in color of the exterior of the building initially, or at any time in the future, shall be subject to review and approval by 3. The applicant agrees to indemnify, hold harmless, and defend the City, its officers, agents and employees from any and all liability or claims that may be brought against the city arising out of its approval of this permits, save and except that caused by the City's active negligence. 4. The applicant shall comply with all federal, state, and local laws, including all city regulations, Violation of any of those laws in connection with the use will be cause for revocation of this permit. 5. These conditions will be reprinted on the cover sheet or first page of construction plans, including grading plans. Environmental 6. The applicant/contractor shall comply with all applicable AQMD standards and requirements during demolition activity. Evidence of AQMD compliance shall be provided to the Building Division prior to the issuance of building permits, Mitigation AQ- I)7. The applicant/contractor shall water the site as necessary during demolition and construction to prevent a visible dust cloud from exceeding 100 feet from the disturbance area. (Mitigation AQ-2)8. The applicant shall suspend all demolition activity under wind conditions exceeding 25 miles per hour. ( Mitigation AQ-3)9. The contractor shall utilize low-emission mobile construction equipment when feasible. (Mitigation AQ-4)10. High occupancy facilities, critical structures, and utilities shall be designed to sustain minimum damage and to continue to function during emergency situations. This shall be demonstrated to the satisfaction of the Building Division prior to the issuance of building permits (General Plan Implementation 7.2.4).Mitigation G-I)11. The contractor shall employ Best Management Practices (BMPs) in conformance with Regional Water Quality Control Board standards for the containment of debris, chemicals, and solvents for the duration of any demolition or construction activities. The contractor shall provide the City with written documentation of proposed BMPs to control stormwater pollution for review and approval by the Public Works Department. (Mitigation 12. The interior noise exposure standard for the Chapman classroom building of 55 dB shall be met using standard building shell construction, This shall be verified by the Building Division prior to the issuance of a building permit. Written verification of compliance with the noise standard, in the form of noise measurement results following building completion, shall be provided to the Planning Department prior to the final building permit inspection. (Mitigation N- 1) 13, All exterior windows and doors shall have a positive seal. Leaks and cracks shall be kept to a minimum. These conditions shall be verified by the Building Department prior to the final building permit inspection, (Mitigation N- 2)14. The applicant in coordination with the contractor shall ensure that demolition and construction activities comply with the following requirements:a, All construction vehicles or equipment, fixed or mobile, shall be equipped with properly operating and maintained mufflers.b. All operations shall comply with City ordinances with respect to hours of construction activity to minimize noise impacts,c. During construction, best efforts shall be made to locate stockpiling and/or vehicle staging areas as far as practicable from surrounding residences. (Mitigation N-3)15. The applicant shall prepare a congestion management plan for City review and approval prior to the issuance of building permits, including specific provisions for drop-off and pick-up activities, and crosswalk monitoring, The Public Works Director or his designee, in coordination with the Police Department and Community Development Department, shall confirm the adequacy of the plan.Mitigation T-I)16, The applicant shall prepare drop-off and pick-up information for distribution to parents of all students prior to the beginning of each school year, A draft of this notice shall be reviewed and approved by th(: Community Development Director and Public Works Director or their designees, in coordination with the Police Department, prior to parent distribution, (Mitigation T -2)17. The applicant shall install two bicycle racks with a combined capacity for ten bicycles on the school campus, The location of these racks shall be indicated on the site plan for Planning Division verification prior to the issuance of building permits. ( 18. The applicant shall prepare a construction traffic management plan for City review and approval prior to the issuance of demolition and/or building permits. At a minimum, this plan shall include a demolition/construction schedule identify expected dates and times of lane closures, and document the shuttle system and schedule for the transport of employees and construction workers from off- site parking lots to the St. John's campus, The adequacy of this plan shall be reviewed and approved by the Community Development Director in consultation with the Public Works Director, or their designees. (Mitigation T-4) Public Works 19, The applicant shall consolidate existing lots so that all existing and proposed buildings have the property setbacks from lot lines. The lot line adjustment process can be used and must be completed prior to the issuance of building permits.20, The applicant shall submit a grading plan to the Public Works Department Engineering Division for review and approval, and a grading permit issued prior to the issuance of building permits.21. The applicant shall dedicate to the City corner cutoffs at the following locations:Northwest corner of Shaffer Street and Almond Avenue;Northeast corner of Shaffer Street and Almond Avenue; and Northeast corner of Almond Avenue and Center Street.22. The applicant shall close unused drive aprons and repair eXlstmg street improvements on Chapman Avenue, Almond Avenue, and Shaffer Street as may be needed and determined by the Public Works Department. This includes constructing a 25- foot radius curb return at the northwest corner of Shaffer Street and Almond Avenue (Ord. 12. 52.030),23. All screening for the mechanical equipment, exhaust systems, and garage door must be architecturally compatible with the building design and surrounding area. Wat,er 24. The applicant shall satisfy all water main connection, plan check, and inspection charges as determined by the Water Division,Reso No, 9540 Landscalili!g 2:5. The applicant shall submit a landscape plan for review and approval by the Design Review Committee prior to the issuance of building permits, Code Provisions The following Code provisions are applicable to this project and are included for information only, This is not a complete list and other Code provisions may apply to the project: Prior to issuance of building permits, the applicant shall pay all applicable development fees, including but not limited to: City sewer connection, Orange County Sanitation District Connection Fee, Transportation System Improvement Program, Fire Facility, Police Facility, Park Acquisition, Sanitation District, School District, and Eastern Foothill Transportation Corridor, as required. Expiration-If not utilized, this proj ect approval expires two years fi'om the approval date.
