RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ORANGE APPROVING NEGATIVE DECLARATION
1653-00 AND GENERAL PLAN
AMENDMENT 4-00 TO ADOPT THE CITY
OF ORANGE HOUSING ELEMENT FOR THE
YEARS
2000-2005.General Plan Amendment
No. 4-00 Applicant:

of Orange RECITALS:WHEREAS, the Planning Commission has authority
per California Government Code Section 65358 to make a recommendation that the City Council amend
the City's
General Plan; and WHEREAS, the California Government Code requires that cities
review and update their housing elements every five years, according to a schedule set forth
by the State Department of Housing and
Community Development; and WHEREAS, the City of Orange has prepared the 2000-
2005 Housing Element, dated June 2001, as an update to its previously approved 1993
Housing Element in compliance
with such requirements; and WHEREAS, a Negative Declaration was prepared, noticed,
and posted for public review in accordance with Article 8, Section 15105 of
the California Environmental
Quality Act Guidelines; and WHEREAS, the Planning Commission has considered
the information contained in Negative Declaration 1653-00, including the initial study
and comments received during the public review process, and has found that the project
will not significantly impact the
environment
or wildlife resources; and WHEREAS, the Planning Commission held one duly
advertised public hearing on September 5, 2001, for the purpose of considering the
2000-2005 Housing Element Update,General Plan Amendment No. 4-
00 and Negative Declaration 1653-00; and WHEREAS, the City Council held a duly
advertised hearing on October 9,2001, to consider the information contained
in Negative Declaration 1653-00, including the initial study and comments received
during the public review process, and General Plan Amendment No. 4-00, an amendment
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Orange that Negative Declaration 1653-00 was prepared in conjunction with General
Plan Amendment 4-00. After considering the information contained in
Negative Declaration 1653-00, including the Initial Study and comments received during
the public review process, the City Council determines that the project could not have a significant
effect on the environment, therefore Negative Declaration 1653-00 is
hereby
adopted and approved.BE IT FURTHER REOLVED THAT General Plan Amendment No.
4-00, to adopt the 2000-2005 Housing Element Update, should be
approved as recommended by the Planning Commission based on the facts more
particularly set forth as follows:I. The Housing Element meets the requirements of State statute contained
in Article 10.
6 of the Government Code.2. The Housing Element is consistent with the policies
and programs contained within
all elements ofthe General Plan.3. The Housing Element advances State housing goals of
decent housing and a suitable living environment for
all members of the community.4. The City's Affordable Housing Plan is the
appropriate vehicle for strengthening its commitment to construction of new affordable
housing units within the City.5. General Plan Amendment No. 4-00 shall become effective
thirty (30) days from and after the
date of adoption of this Resolution.6. The City Clerk is hereby authorized and directed to (
a) make copies of this Resolution available to the general public within one (I) working
day following the date of adoption,and (b) furnish to any person making a request for
a copy of the adopted documents amending the General Plan within two (2) working days
after receipt of a request therefor accompanied by payment
for the reasonable cost of copying.ADOPTED
