Present: Trustees Brandman, Cavecche, Clark and Gorham. 1.3 Adaption of Agenda Trustee Cavecche moved that the agenda be adopted. Seconded by Trustee Gorham. 1.4 Approval of Minutes Trustee Gorham moved that the minutes of the meeting held June 20, 1994, be accepted. Seconded by Trustee Clark. II. BOARD REPORTS There were no reports from Trustees. The new format of the agenda was discussed. Chair Brandman requested that sections New Business" and "Oral Presentations" section be placed near the end of the agenda. When the agenda is created for October, the secretary will get the agenda format approved by the Chair before it is distributed. Chair Brandman asked other Trustees to consider changing their meeting time after the new Trustee is appointed by City Council. She would like to have morning meetings. ORANGE PUBLIC LIBRARV 101 N. COMMUNITY SERVICES DIRECTOR REPORTS 3.1 Monthly Reports for July and August 1994 July and August Director's Reports were distributed and reviewed at the meeting. Gary commented that he will get these reports to Trustees in a more timely manner to give Trustees time to read and consider the information that is contained in these reports. Homework tutors were discussed by the Trustees. The Library does not currently have a list of tutors available for homework help and patrons aze referred to the school district for this information. George Gorham's letter of September 9 to City Manager David Dixon regarding a library ad hoc committee was reviewed and briefly discussed. Chair Brandman also distributed her letter addressed to Mr. Dixon regazding the same ad hoc committee. The July and August Director's Reports were accepted. 3.1 Legislative Update Gary reported to Trustees that SB 1448, the library service assessment bill, has not been signed by the Governor. Gary felt a separate entity should promote this bill for the library if this is the direction the Board wishes to go. IV. DEPARTMENT REPORTS 4.1 Publicity Trustee Clark questioned why the public is not advised of the grant money applied for and received by the library and where this money is used in the library. Gary advised that sometimes there aze misquotes in the news media and many times the good news is not reported. All grants are presented and approved by City Council and the newspapers are not usually contacted when the library receives a grant. Grants aze publicized in the Orange Public Library Newsletter and all grant monies are used for library materials and books. 4.2 Friendly Stop Inventory Trustee Clark questioned the inventory of material from the Friendly Stop that was brought back to the Main Library and accounted for to the Califomia State Library. Joan Blumenstein was the last Supervisor of the Friendly Stop before its closing in June 1994 and she reported that the only item at the Friendly Stop that was purchased by Friends of the Orange Public Library was a light pen. Because Trustee Clark wanted further clazification on some items, this item will be placed on the October agenda. CITY OF ORANGE COMMUNITY SERVICES DEPARTMENT ORANGE PUBLIC LIBRARYBOARD OF TRUSTEES Minutes of Meeting ofSeptember 19, 1994 Page 3 4.3 Homebound Delivery Service Trustee Clark had this item put on the agenda. She requested that the library consider a sepazate collection for the Homebound Delivery Service patrons only - a collection that would not be available to patrons visiting the library. She felt the collection appeared shabby and had received a complaint about a malfunctioning tape. Staff advised that all tapes aze reviewed when they aze reported as damaged. Trustee Clazk will bring this matter up again with Friends of the Orange Public Library and report back to the Boazd. Gary advised that Friends could implement this special collection when a formal plan has been written and adopted byTrustees. 4.4 Library Assessment Tax The information provided in the Trustees' packets regarding the successful Assessment District Tax passed in Pasadena was discussed. Chair Brandman commented that this work toward an assessment district tax must be done by an independent person for the benefit of the librazy and its users. She has requested that this item be kept on the agenda indefinitely so that information will be gathered each month and discussed. Chair Brandman would like to see all library staff and supporters go out into the community and show their interest in this tax. Friends of the Orange Public Library will be brought in to also participate in this campaign. 4.5 Board Letter to Ci Council Requesting Definition of Board Responsibilities Chair Brandman h requested a letter be sent to City Council tQ have Council define the roles of the Library Board. Vice-Chair Cavecche hadbeen asked to compose this letter as Chair Brandman feels any attempt on her own part to approach the Council may be interpreted as politically motivated. rro letter was sent. At this time, the question of the Board's status, administrative versus advisory, was discussed in detail. Trustee Clark presented Chair Brandman with a letter dated September 19, outlining the bylaws of the Orange Public Library Board of Trustees, State Education Code Section 18900 through 18965, Trustee Tool Kit for Library Leadership, a Letter from Gary E. Strong, California State Librarian dated July 13, 1987, the 1991, 1992 and 1993 California Public Library Reports and Orange Public Library September 1993 and Department of Community Services July 1994 organizational charts. Chair Brandman requested that a copy of this entire letter with attachments be added to the minutes. Trustee Ya1& cavecche also added Orange Municipal Code Chapter 2.72, "Public Library," Section 2.72.010 into the minutes. Also added was Superior Court No. C673083 California Court of Appeal, Second Appellate district, Division Two, an appeal filed on June 7, 1989 entitled Friends of the Library of Monterey Park, et al., CITY OF ORANGE COMMUNITYSERVICES DEPARTMENT ORANGE PUBLIC LIBRARY BOARD OF TR USTEES Mrnutes of Meeting of September 19, 1994 Page 4 Respondents, v. City of Monterey Pazk, et al., Appellants. Trustee Cavecche advised that she had been in contact with Sy Silver of the Califomia State Library and was advised that their boazd is administrative, and further, that the State Library would be agreeable to attend a City Council meeting and advise Council members of this Board's administrative status. Trustee Cavecche further Library commented that the(ydl•ql should not be used as a politicai football. Trustees felt that their input should have been sought before the Library was made a branch of the Community Services Department. Gary explained that both departments were performing similaz "people business" for the community in children's programming and adult services and that the City is still reseazching other azeas of consolidation. The Trustees still questioned why the departments were combined after the one year trial. At this time Gary asked Trustees for their position on his directorship of the library and each Trustee voiced their approval of Gary's leadership at the library. Trustee Cavecche moved that the ad hoc committee appointed by City Council to investigate and advise the Council regazding library issues does not have any legal responsibility; that the ad hoc committee report its reseazch to the Board of Trustees, not the City Council; and the ad hoc committee cannot make any decisions regazding library policy. Seconded by Trustee Clark. Motion carried unanimously. Trustees requested a line-by-line budget print-out monthly. Orange Public Library staff inembers left at thds time.) 4.6 City of Orange and Rancho Santiago College Joint Use Library Project This will be a continuing item on the agenda. Dean Stringer advised Trustee Cavecche the joint use library project has been delayed another year, however, the planning for the library is continuing. Dean Stringer also advised Trustee Cavecche that the college needs to know if the City is still interested in this joint project as it appears the City has lost interest. The architect planning the project will be invited to make a presentation to Trustees at the October or November meeting. This project will be funded 25% by the City of Orange and 75% by Rancho Santiago College. 4.7 Collection Development and Weeding Policy Time did not permit this item to be discussed. It will be brought before the Board next month. She asked Trustees to review the quesfions that are on the survey and to telephone her with their suggestions and/or additions by next week. This survey will help the library find out how patrons feel about the library services. The results of the survey will be reviewed by Trustees. V. ORAL PRESENTATIONS 5.1 Children's Section Concern Gary advised Trustees it is library policy that adults are not allowed in the Children's Section of the ]ibrary while children are out of school and present in tbat area. Unaccompanied adults are asked to leave this area. Although there is not a notice posted, the police will be called if a patron does not leave the area when requested. Since there was so much confusion regarding the status of the board, I decided to do some research and found the following information: 1) Bylaws of the Orange Public Library Board of Trustees - Article 1 states that this organization existing by virtue of the provisions of Chapter 18900 of the Laws of the State of California, and exercising the powers and authority and assuming the responsibilities delegated to it under the said statute. 2) State Education Code Section #18900 through #18965 - Copy of the most recent edition from Main Library Reference with the 1994 Supplement including Notes of Decisions. #18910 - Appointment of board of trustees: The public library shall be managed by a board of library trustees". 3) Trustee Tool Kit for Library Leadership - published by The California State Library, page 10 states: "In the case of general law cities, state law provides that if the city opts to establish a library, "the public library shall be managed by a board of library trustees." 4) Letter from Gary E. Strong California State Librarian - subject: GOVERNANCE OF PUBLIC LIBRARIES IN GENERAL LAW CITIES, page 4, question 3(c) : "May a board of library trustees appointed under Education Code section 189010 act solely as advisory"? Conclusion: A board of library trustees cannot exist solely as an advisory body. Education Code section 18910 specifies that the public library "shall be managed" by the trustees. The plain meaning of manage" denotes active participation in supervising, directing, and administering a program. Had the Legislature intended the trustees to function in an advisory capacity, it could have so limited their responsibilities." 5) California Public Library Reports: 1992 - "Trustees and Friends Supplement" Item A, #1 is marked showing board is Administrative.
