RES-9513 Lot Line Adjustment Approval No. LL-2001-10RESOLUTION NO. 9513 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING LOT LINE ADJUSTMENT LL- 2001-10 ADJUSTING LOT LINES OF CERTAIN REAL PROPERTY DESCRIBED AS 388, 396, 404, 414, 422 AND 438 SOUTH ESTATE DRIVE. (LOTS 1,2,3,4,5,6, A, D & E OF TRACT MAP NO. 15519 IN THE CITY OF ORANGE,COUNTY OF ORANGE, STATE OF CALIFORNIA,RECORDED IN BOOK 778, PAGES 18 THROUGH 21,INCLUSIVE, OF MISCELLANEOUS MAPS, IN THE OFFICES OF THE COUNTY RECORDER OF SAID COUNTY).WHEREAS, Section 66412 (d) of the Subdivision Map Act makes provisions for the Council to approve lot line adjustments by resolution where the land taken from one parcel is added to an adjacent parcel and where a greater number of parcels than originally existed is not thereby created; and WHEREAS, the City Council has enacted Orange Municipal Code Sections16.32.010 et seq., which provide the procedure to be followed for the approval of said lot line adjustment; and WHEREAS, the Subdivision Section of the Public Works Department mc1 the Staff Review Committee have reviewed and recommended approval of Lot Line Adjustment No. LL 2001-10 and have made a finding that the real property situated at 388,396,404,414,422 and 438 South Estate Drive in the City of Orange, described as Parcels 1 through 2 in Exhibit " A" attached hereto and graphically depicted on the map attached hereto as Exhibit "B", complies with the provisions of the California Subdivision Map Act and all applicable City of Orange ordinances and regulations, including the requirements for building sites; and WHEREAS, the Subdivision Section of the Public Works Department and the Staff Review Committee have made the following findings:1" That the proposal is eligible for processing as a lot line adjustment pursuant to Section 66412 of the Subdivision Map Act;2. That the requirements of the California Environmental Quality Act have been met;3. That the proposal is consistent with the General Plan; and 4. The lot line adjustments were to done in two phases with the vacation/dedications included in the second phase. The Developer for Tract 15519 has declared bankruptcy and is in receivership. The Engineer, BV Engineering has requested that the City hold off recordation of Lot Line Adjustment 2001-10 until ownership issues are cleared up for this Tract. Per our mutual understanding no further processing will be done at this time on the phase 2 lot line adjustment in as much as the ownership of the individual lots are changing due to continued recordation of the residenliallots"AlsO, with respect to the phase 1 lot line adjustment that has been approved for recordation it was agreed that it will be held by the city until further notice.I also advised you that the setting of final monuments has not been completed and that it may be necessary to act against the monumentation bond to assure completion of their selting in the positions described on the above referenced lot line adjustment.
