A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE DETERMINING THAT A
PROJECT AREA COMMITTEE SHALL NOT BE
FORMED IN CONNECTION WITH THE AMENDED
AND RESTATED REDEVELOPMENT PLAN FOR
THE SOUTHWEST ORIGINAL, SOUTHWEST
AMENDMENT NO.1, SOUTHWEST AMENDMENT
NO.2, SOUTHWEST AMENDMENT NO, 3, TUSTIN
STREET ORIGINAL, TUSTIN STREET
AMENDMENT NO. 1 AND NORTHWEST
REDEVELOPMENT PROJECTS
WHEREAS, the Orange Redevelopment Agency ("Agency") has undertaken steps toamendandmergetheRedevelopmentPlansfortheSouthwestOriginal, Southwest AmendmentNo. I, Southwest Amendment No.2, Southwest Amendment No, 3, Tustin Street Original,Tustin Street Amendment No, I and Northwest Redevelopment Projects ("Project Areas"); and
WHEREAS, the Agency is required to complete the actions prescribed by Sections
33354.6 and Sections 33485 through 33489 of the California Community Redevelopment Law,
Health and Safety Code Section 33000 et seq, ("CRL"); and
WHEREAS, Section 33385.3(a) of the CRL requires that if a project area committee
does not exist, and the agency proposes to amend a redevelopment plan, the agency shall
establish a project area committee pursuant to Section 33385 of the CRL if the proposedamendmentwould (I) "Grant the authority to the agency to acquire by eminent domain propertyonwhichpersonsresideinaprojectareainwhichasubstantialnumberoflow- and moderate-
income persons reside"; or (2) "Add territory in which a substantial number of low- and
moderate-income persons reside and grant the authority to the agency to acquire by
eminent domain property on which persons reside in the added territory, The project area committeemaybecomposedofpersonsfromonlytheaddedterritoryorboththeaddedareaandtheexistingprojectarea";
and WHEREAS, the proposed Amended and Restated Redevelopment Plan for theMergedandAmendedProject ("Plan") will not add territory to the existing Project Areas, nor will
it grant the authority to acquire by eminent domain property on which any persons reside in
a project area in which a substantial number of low- and moderate-income persons
reside; and WHEREAS, the Agency will follow an alternative citizen participation
program in connection with the Plan, as prescribed by Section 33385(f)
ofthe CRL,NOW, THEREFORE, the City Council of the City of Orange does hereby
resolve
as follows:
I. The City Council hereby finds and determines that the formation of a project areacommitteeisnotrequiredfortheadoptionoftheAmendedandRestatedPlanfortheMergedandAmendedRedevelopmentProject.
