RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ORANGE OVERRULING THE DECISION OF
THE PLANNING COMMISSION AND UPHOLDING
APPEAL NO. 479, GRANTING A REQUEST
TO ALLOW A WINDOW REPLACEMENT
AT PROPERTY LOCATED AT 212 S.
ORANGE, WITHIN THE OLD TOWNE DISTRICT.

WHEREAS,
on September 21,2000, the Design Review Committee (DRC) No. 3458 denied
applicant's request for approval of replacement windows on a Craftsman Bungalow residence
located at 212 S. Orange, in the Old Towne District; and WHEREAS,
on October 2, 2000, the Planning Commission of the City of Orange conducted
a public hearing to consider Appeal No.4 78 from the DRC denial; and WHEREAS,
following said public hearing, the Planning Commission also denied applicGmt'
s appeal; and WHEREAS,
Appeal No. 479 was timely filed by the appellant, Councilman Mike Alvarez;
and WHEREAS,
the City Council heard the appeal of appellant by conducting a public hearing
on December 12, 2000; and WHEREAS,
at
said public hearing, the City Council heard the testimony of the applicGmt, four
members of the public opposed to the appeal and five members of the public in favor of
the appeal; considered both documentary and physical evidence presented; discussed specifie issues
with staff; and found the facts more particularly set forth as follows:1. The
project is found to be consistent with the Old Towne Design Standards and therefore is
categorically exempt from the provisions of the California Environmental Quality Act (CEQA)
per section 15331 of the State CEQA Guidelines.
2. The proposed window replacement is not contrary to the Secretary of the Interior
Standards:, which discourages removing or changing windows that are important in defining the
historical character of the building so that, as a result, the character is diminished.
3. The Historic Resource Inventory for the aforementioned property makes no
reference to the subject attic windows as character defining.
4.
The design elements of the property listed in the Historic Resource Inventory remain
vt:ry much intact.5.
The new wooden windows are historically accurate in size, style, and placement.NOW,
THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that
Appf'al No.4 79 is upheld for the following reasons:1.
The foregoing recitals are true and correct.2.
The window replacement does not remove, change or in any way diminish the historical
character of the property and is consistent with the design standards and characteristics of
the Old Towne District.ADOPTED
