RES-9655 Revising Conflict of Interest CodeRESOLUTION NO. 9655 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE REVISING THE CONFLICT OF INTEREST CODE FOR THE CITY OF ORANGE. WHEREAS, the Political Reform Act, Goverrunent Code Sections 81000 et seq., requires the City to adopt and promulgate a conflict of interest code; and WHEREAS, the City has complied with this requirement by adopting by reference the model conflict of interest code developed by the Fair Political Practices Commission as the ConOict ofInterest Code for the City; and WHEREAS, the Political Reform Act, in Goverrunent Code Section 87306.5, requires the City to review and revise as necessary, its Conflict of Interest Code every even- numbered year; and WHEREAS, the City has determined that due to changes in City employee positions and titles, tbe City's ConOict of Interest Code requires revision. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: J. The list of designated employees required to file statements of economic interests is hereby amended to include those persons as set forth in Exhibit A, which is attached hereto and incorporated herein by this reference. 2. Only those persons who are designated in the City's Conflict ofInterest Code for the first time are required to file an initial statement as defined in Section 5(A) of the City's Conflict ofInterest Code. The City Manager's determination is a public record and shall be retained for public inspection in the same manner and location as this Conflict of Interest Code. 3 DISCLOSURE CATEGORIES Catel!orv 1 Category I relates to interesls in real properly within or close (2 miles) to the City of Orange in which the designaled employee, spouse and dependent children have an aggregale interest of $1.000 or more in value. It includ.:s inlerests in real properly held by a business entity or trust in which Ihe employee, spouse and dependent children have an aggregate inlerest of 10% or more. Calel!orv 2 Category 2 relates to investments held by the designated employee, spouse and dependenl children, with an aggregate value of more than $1,000, in business enlilies having real property in the City of Orange or doing business, planning to do business, or having done business in the City of Orange within the past two years. It includes investments held by a business enlity or trust in which the filer, spouse and dependent children have an aggregate interesl of 10% or greater. Catel!on 3 Category 3 relales 10 sources of income (including loans) aggregating $250 or more iIthe source is located wilhin or doing business within the City of Orange. It includes gifts aggregaling $50 or more whether or nole Ihe source (donor) is in the City of Orange. It includes sources of income to Ihe designated employee, to the designaled employee's community properly interest in the income of a spouse, and to the employee's pro rata share of any income of a trusl in which the employee, spouse or dependenl children have individually or collectively an aggregale interesl of 10% or grealer.
