RES-9658 Habitat Conservation Fund Program Grant Application FY 2002-03 to Restore Natural HabitatRESOLUTION NO: 9658 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING THE APPLICATION FOR GRANT FUNDS FOR FISCAL YEAR 2002-03 UNDER THE HABITAT CONSERVATION FUND PROGRAM OF THE CALIFORNIA WILDLIFE PROTECTION ACT OF 1990 FOR THE RESTORATION OF THE NATURAL HABITAT ALONG A PORTION OF SANTIAGO CREEK FROM THE BOUNDARY BETWEEN THE CITIES OF SANTA ANA AND ORANGE TO CAMBRIDGE STREET.WHEREAS, the people of the State of California have enacted the California Wildlife Protection Act of 1990, which provides funds to the State of California for grants to local agencies to acquire and/or develop facilities for public rec:reational and fish and wildlife habitat protection purposes (the Program); and WHEREAS, the State Department of Parks and Recreation (DPR) has been delegated the responsibility for the administration of a portion of the Program within the State, setting up necessary procedures governing application by local agencies under the Program; and WHEREAS, said procedures established by the DPR require the applicant to certify by resolution the approval of an application before submission of an application to the State; and WHEREAS, by its adoption of Resolution No. 9548 on February 26,2002, this City Council authorized the tiling of an application jointly with the Santiago Creek Greenway Alliance for an Urban Streams Restoration Grant for the restoration of that portion of Santiago Creek between Cambridge Street and the boundary between the cities of Orange and Santa Ana, consisting of the removal of debris, pest plants such as Arundo, and the restoration of native vegetation (herein referred to as the Project); and WHEREAS, by its adoption of Resolution No, 9548, this City Council found and determined that the Project would be environmentally beneficial and categorically exempt from requirements of the California Environmental Quality Act (CEQA) under Sections 15301 and 15304 of the State CEQA Guidelines because the Project consists of a minor alteration in the condition of the land and/or the repair, maintenance or minor alteration of existing topographical features, involving negligible or no expansion of use beyond that previously existing; WHEREAS, DPR requires that an application for grant funds under the Program must contain certain assurances with which the City must comply; and WHEREAS, if the City's application is approved by DPR, the City will be required to enter into an agreement with the State of California for acquisition or development of the Proje:ct, as the case may be; and WHEREAS, this City Council reaffirms its belief that the Project is in the best inter'~sts of the City and the health, safety, morals and welfare of its residents, and in accord with the public purposes and provisions of applicable state and local law and requirements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange, on the basis of the facts set forth in the agenda report presented to it and any testimony received at the meeting at which this matter was considered, as follows: Section 1.The foregoing recitals are true ,md correct. Section 2. The City Council finds and detennines that the Project and the application for a grant under the Program are categorically exempt from CEQA pursuant to Sections 15301 and 15304 of the State CEQA Guidelines. Section 3. The City Council hereby certifies that it understands the assurances and certifications contained in the application form, including the requirement that the City match the amount of grant funds. Section 4. The City Council hereby certifies that it has or will have available prim to commencement of any work on the Project the required matching funds in an amount not less than $75,000 and will have sufficient funds to operate and maintain the Project. Section s. The City Council hereby approves the application to DPR for a Program grant and, to that end, authorizes and directs the City Manager, as agent of the City, to execute the application and such other documentation as DPR requires to consider the application and as the City Manager otherwise deems necessary and appropriate to consummate the transaction contemplated by th~ adoption of this Resolution and to administer the City's obligations, responsibilities and duties to be performed hereunder and under the grant contract, and all actions previously taken by such officers and employees in connection with the application and contract are ratil1ed and approved. Section 6. If offered such a grant, this City Council hereby authorizes and directs the City Manager to accept and sign any contract for administration of the grant funds on behalf of the City and such other documentation.
