RES-9598 Amending Master Fee Schedule for Temporary Use Permit ChargesRESOLUTION NO. 9598
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE ESTABLISHING TEMPORARY
USE PERMIT CHARGES FOR THE
IMPLEMENTATION OF SECTION 17.10.035 OF THE
ORANGE MUNICIPAL CODE AND AMENDING
THE CITY'S MASTER SCHEDULE OF FEES AND
CHARGES.
WHEREAS, the City Council has adopted an ordinance establishing a permit process
and standards for temporary uses; and
WHEREAS, the City is entitled to compensation from private enterprises
establishing temporary uses for the purpose of economic gain, expanding a business activity,
increasing useable floor area, or storage of property; and
WHEREAS, there is a need for the City to review requests for the establishment of
non-recurring and recurring or seasonal temporary uses to ensure that such uses do
not generat(' nuisances that are detrimental to surrounding properties;
and,WHEREAS, the aforementioned ordinance calls for the City Council to adopt
by resolution Temporary Use Permit charges;
and WHEREAS, the aforementioned Temporary Use Permit charges are intended
to recover the actual cost to the City of processing requests for recurring and
non-recurring temporary
uses; andNOW, THEREF'ORE, BE IT RESOLVED by the City Council of the
City of Orange
as follows:Section 1.The foregoing recitals are true
and correct.Section 2. That the Temporary Use Permit fee to be paid in conjunction
with the filing of a Temporary Use Permit application for nonrecurring uses shall be in an
amount of
150.00.Section 3. That the Temporary Use Permit fee to be paid in conjunction
with the filing of a Temporary Use Permit application for recurring or seasonal uses shall be
in an amount of$
52.00.Section 4. The fees for Temporary Use Pernlits shall be added to the
Master Fee Schedule and adjusted as needed to reflect increases in actual staff processing costs,
Section 5. Be it further resolved that this Resolution shall become operative upon
the effective date of Ordinance No. 3-
