RES-9585 Application for Matching Grant Funds Santiago Creek Trail ProjectRESOLUTION NO. 9585 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING AN APPLICATION FOR MATCHING GRANT FUNDS UNDER THE FEDERAL PARKS SERVICE LAND AND WATER CONSERVATION FUND GRANT- IN-AID PROGRAM FOR THE SANTIAGO CREEK TRAIL PROJECT,WHEREAS, the Congress of the United States under Public Law 88-578 has authorized the establishment of a Federal Land and Water Conservation Fund Grant-In-Aid Program (the "Program"), providing matching grant funds to the State of California and its political subdivisions for the acquisition of lands and the development of facilities for public outdoor recreation purposes; and WHEREAS, the Department of Parks and Re:creation for the State of California DPR") is responsible for the administration of the Program in the State of California,setting up necessary rules and procedures governing applications by local agencies under the Program; and WHEREAS, DPR has established and adopted said procedures, which require,among other things, that the legislative body of a local agency desiring to submit an application for funds under the Program certify by resolution the approval of its application and the availability of local matching funds; and WHEREAS, this City Council has heretofore approved the alignntent and conceptual design plans for the Santiago Creek Trail Project (the "Project"), which will consist of a multi use pav,ed trail extending along Santiago Creek from the jurisdictional boundary between the City of Orange and the City of Santa Ana to a point located just east of the 55 freeway at Palmyra. Construction plans and specifications are now being prepared for the first phase of the Project, located between the jurisdictional boundary of the City of Santa Ana and Tustin Street ("Phase I"). Once prepared, the plans and specifications will be considered by the City Council for approval and authorization to obtain bids for the construction of Phase I of the Project; and WHEREAS, the City Council hereby finds and determines that the Project is consistmt with the City's Master Plan of Bikeways, the Major Riding and Hiking Trails and Off-Road Paved Bikeways Plan of the County of Orange, the Statewide Comprehensive Recreation Resources Plan and the 1994 California Outdoor Recreation Plan; and WHEREAS, the City Council further finds that the Project is compatible with the land use plans of the City of Santa Ana and the County of Orange, which are the WHEREAS, this City Council further finds and determines that the City of Orange has estimated in its Capital Improvement Plan for Phase I of the Project that it will cost 640,244; and WHEREAS, this City Council further finds and determines that the City of Orange has, and is able to devote to Phase I of the Project, funds in an amount sufficient to finance the total cost of Phase I of the Project upon the basis that one-half of the total cost up to, but not in excess of, $250,000 will be reimbursed to the City by DPR upon completion of the improvements thereof; and WHEREAS, on June 12,2001, the City Council adopted a Negative Declaration for the entire Project under the authority and requirements of the California Environmental Quality Act ("CEQA"), thereby finding that the ProJect would not have a significant adverse impact on the environment; and WHEREAS, this City Council believes that Phase I of the Project and the Project, as a whole, is in the best interests of the City and the health, safety, morals and welfare of its residents, and in accord with the public purposes and provisions of applicable state and local law and requirements.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange, on the basis of the facts set forth in the agenda report presented to it and any testimony received at the meeting at which this matter was considered, as follows:Section 1.The foregoing recitals are true and correct.Section 2. The City Council certifies that it has (or will have) sufficient funds available and devoted to the implementation of Phase I of the Project, subject to reimbursement of one-half but not more than $250,000 of the total cost of that phase of the Project.Section 4. The City Council certifies that Phase I of the Project and the Project, as a whole, is compatible with the land use plans of those jurisdictions immediately surrounding the IProj ect.Section 5. The City Council hereby approves the application for funds in the amount of $250,000 under the Program, in the form presented at this meeting, and authorizes and directs the City Manager to execute the application and such other documentation as DPR requires to consider and process the application and to submit same to DPR.Section 6. The City Council hereby appoints the City Manager as agent of the City to conduct all negotiations and execute and submit all documents, including, but not limited to, applications, agreements, amendments, billing statements, and such other documentation as the City Manager deems necessary and appropriate to consummate the Reso No. 9585 transaction contemplated by the adoption of this Resolution and to administer the City's obligations, responsibilities and duties to be performed hereunder and under any agreement entered into with DPR or the Federal Government in connection with the Program, and all actions previously taken by such officers and employees in connection with the application and contract are ratified and approved.
