RES-9548 Application for Urban Streams Restoration GrantRESOLUTION NO. 9548 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ENDORSING THE JOINT FILING WITH SANTIAGO CREEK GREENWAY ALLIANCE OF AN APPLICATION FOR AN URBAN STREAMS RESTORATION GRANT FOR A PORTION OF SANTIAGO CREEK WITHIN THE CITY; CONDITIONALLY ACCEPTING THE GRANT IF OFFERED; DESIGNATING A CONTRACT MANAGER AND FISCAL AGENT; AND MAKING CERTAIN FINDINGS WITH RESPECT THERETO. WHEREAS, the California Department of Water Resources, Division of Local Assistance, Urban Streams Restoration Program has announced the availability of funds for grants; and WHEREAS, said grants are intended to help solve flooding and erosion problems in a way that provides environmental enhancement; and WHEREAS, the Santiago Creek Greenway Alliance has proposed to co-sponsor a grant application with the City of Orange for the restoration of Santiago Creek between Cambridge and the western City boundary, consisting of the removal of debris, pest plants such as Arundo, and the restoration of native vegetation (herein referred to as the Project); and WHEREAS, this City Council finds and detennines that the Project proposed for funding with the grant funds would be environmentally beneficial and categorically exempt from requirements of the California Environmental Quality Act (CEQA) under Sections 15301 arld 15304 of the State CEQA Guidelines because the Project consists of a minor alteration in the condition of the land and/or the repair, maintenance or minor alteration of existing topographical features, involving negligible or no expansion of use beyond that previously existing; and WHEREAS, this City Council considers the prospects of receiving a grant to be reasonably likely and believes that the Project is in the best interests of the City and the health, safety, morals and welfare of its residents, and in accord with the public purposes and provisions of applicable state and local law and requirements.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange, on the basis ofthe facts set forth in the agenda report presented to it and any testimony received at the meeting at which this matter was considered, as follows:Section 1.The foregoing recitals are true and Section 2. The City Council finds and determines that the Project and the application for an Urban Streams Restoration Grant are categorically exempt from CEQA pursuant to Sections 15301 and 15304 of the State CEQA Guidelines. Section 3. The City Council hereby approves the joint application with Santiago Creek Greenway Alliance to the California Department of Water Resources for an Urban Streams Restoration Program grant and, to that end, authorizes and directs the City Manager to execute an application and such other documentation as the California Department of Water Resources requires to consider the application. Section 4. If offered such a grant, this City Council hereby authorizes and directs the City Manager to accept and sign any contract for administration of the grant funds on behalf of the City and such other documentation as the City Manager deems necessary and appropriate to consummate the transaction contemplated by the adoption of this Resolution and to administer the City's obligations, responsibilities and duties to be performed hereunder and under the grant contract, and all actions previously taken by such officers and employees in connection with the application and contract are ratified and approved. Section 5. If offered such a grant, this City Council hereby authorizes and directs the Project Manager to develop a work plan for the Project. Section 6. If offered such a grant, this City Council hereby authorizes and directs the Director of Finance to submit invoices to the California Department of Water Resources for activities carried out under the work plan for the grant contract.
