Status report
on abandoned shopping carts. (C2500.B)Councilwoman Coontz reported, she
and Mayor pro tem Barrera serve on a committee that is investigating ways to resolve
this problem in the community. Meetings have been held with six of the major grocery chains,
the California Grocers Association, and staff representatives from the City. The grocery stores
reported on their voluntary plans to deter customers from removing carts from the premises.
The California Grocer's Association has prepared an informational video which will be reviewed
for its suitability for local cable television.Oliver's Cart Recovery
Service collects carts within hours after receiving a report, twice a day for some stores. Faster response
time is determined by the individual stores and at some stores, store personnel participate in recovering
carts.Each store has been
requested to file a voluntary plan of action with the City. The City Attorney and Police Department areworkingonaCityordinanceforCouncilconsideration. The proposed ordinance would include a

Bob Breskin, committee member, reported on the following new proposals:Get the Library out of the General Fund and into a private self-funding or other typemethod.Based on historical costs of what percentage of the budget the Police and Fire represent, allocate income based upon the budget, and let the Police and Fire Chiefs take the dollar figure andspenditthebestwaytheycan. Do not micro manage them, but allow them to manage theirdepartment
budget.Wages were reviewed over the last three years, and it was recommended an overall rollback
of wages, either for one or two years, would be fair, if all City employees took the samehit.All committees should be sunset at the end of the year. New committees should be limitedtothreetosixmonthmaximum
terms.Privatization of Parks and Recreation, cleaning service, and other areas need to be reviewedtoseeifaprivateorganizationcandothejobforlessmoney.Computer service contract for the City should be reviewed, and computer hardware, software and personnel should be
re-evaluated.Specific Cuts - Fire Department should eliminate some positions now rather than waitingforattritiontooccur. Employees that are being cut could cover for employees that are onvacationortrainingtime, etc, reduce amount of contractual time
off.Water Department - The City has a great deal of capital invested in the Water Department, thereturnincapitalcouldcomebacktotheGeneralFund.
Transfer the Orange Progress to the Parks and Recreation Division.
Community Development Department - To save money, explore ways for multiple building inspectionstooccurinonetrip. Concern was expressed that inspection criteria is not in writing.MOTION

The Street Superintendent reported the program does not provide for shrubs, strictly trees. TheCityasksthecooperationofthepropertyownertotrimtheshrubs.
The reserve balance is projected to be between $500,000 and $800,000 in unappropriatedreservesattheendoftheyear. If the $268,000 is removed, there is still between $200,000 to500,000 as a reserve balance. Tree trimming is based on the number of units that are served intheCitytoday, approximately 21 cents per $100,000 of the program. The proposal to increase to28centsisfornextyear.

Applicant: City of Orange Discussion: Mayor pro tern Barrera expressed concern that the resolutiondidnothaveaconditionalusepermitattachedtothedensity, and thought it was to be included. This is a special area in the community with large lots and Council should have control of whatwillbebuiltthere.There does not need to be an overlay, but would like the conditionalusepermitaddressedfordensityas
it is for demolition.The City Attorney commented the resolution would rezone the propertiestoR2-6. After the public hearing on May 25, ] 993, this resolution was preparedaccordingtoCouncil's actions.However, if a conditional use permit would be required before anybuildingtakesplace, then a new zone would be created. That is a different zoning actionandasubstantialmodificationtoCouncil's action. It would require new hearings, either reopeningthepublichearingorpossiblygoingbacktothePlanningCommission. Council mayimposeadditionalmitigationmeasures, but more in line with a mitigation measure to require a conditional use
permit for a demolition permit.Mayor pro tem Barrera commented there are mitigation measures becauseofthedifferentsizesoflotsandeachshouldcomeinonitsownmerit. Council should determine what

that street. The intent of the motion was for the zoning to stand and a conditional use permit be
placed on what will be built in the area. It is also the intent to not have another public hearing
process, but to have Community Development come up with creative suggestions.
Councilwoman Coontz asked for clarification on voting procedures, since she voted no at the
public hearing. The City Attorney opined this action was not on the merits of the public hearing,
rather a procedural action.

Chambers, 242 S. Olive, distributed a real estate flier depicting the King's home for sale at 222
W. Palmyra that has a second unit advertised, but no building permits are on file. Also attached
to the flier is a zone change proposal. The house is located in Area D of Old Towne and is
scheduled for a Planning Commission public hearing August 2, 1993. Mr. Chambers requested the
public hearing be canceled until the information is produced.The
City Attorney opined the Planning Commission has scheduled the public hearing and Council,at
this time, cannot take any action.The
Director of Community Development reported he would search the records for building permits
and announce his findings at the Planning Commission meeting to be held on August 2,1993.
POTENTIAL
STREET HAZARD - SANTIAGO BOULEVARD AND LAKESIDE Carole Walters,
534 N. Shaffer St., was notified by Johnny Johnson, 2736 Lakeside Avenue,regarding the
danger of potential accidents at the intersection of Santiago and Brookside. Also, a petition was
submitted to the Mayor and City Council on the same subject.Mayor Beyer
indicated the City has tried to communicate with the City of Villa Park and Ralphs Grocery Store,
but there has been little cooperation. Mayor Beyer suggested Mrs. Walters present the
petition to the Mayor of Villa Park and bring this concern to him.11. RECESS

THE APPELLANT STATES THE FOLLOWING REASONS FOR THE APPEAL:
The high school's purpose for wanting lights on the athletic field was to primarily facilitate latepracticesduringthedarkerwintermonths. Because of addressing our neighbors' concern overthepossibilityofnightfootballgames, we did not catch the change in dates specified in anamendmentforusageoftheselights. The Planning Commission voted approval of the lights to beusedforaperiodfromSeptemberIstthroughDecember31st. We are requesting that the
approved period be shifted to the darker months beginning with daylight savings on October 15ththroughFebruary29th. There will still be no night football games. Thank you."
MAYOR BEYER OPENED THE PUBLIC HEARING.
The Director of Community Development gave the report with the use of a wall exhibit depictingthefootballfieldarea. It is being proposed to illuminate the field with three 70 ft. tall lightstandardsonthenorthedgeofthefootballfieldarea. The school is proposing to use them forweekdaypracticeswithan8:30 P.M. curfew. Their football games are on Saturdays.
The Planning Commission approved the lights including a condition that they be used MondaythroughFriday, not be used later than 8:30 P.M. and they be limited to use between SeptemberIstandDecember31st. After the public hearing, the applicant reassessed their needs and hasrequestedtheconditionbemodifiedasstatedintheappeal.
Michael Monarch, 2061 Seminol, Tustin Ranch, representing the appellant, clarified the request isfromSeptember1stthroughFebruary29th.

13.2 LANDSCAPE MAINTENANCE DISTRICT NO. 86-2, COLLECTION
OF ASSESSMENTS, CITY OF ORANGE: (LI200.
0)Time set for a public meeting on petition by the City of Orange to receive and consider
public testimony regarding the annual levy of assessments for the next ensuing fiscal year to provide
for the costs and expenses necessary to pay for the maintenance of the improvements in
Landscape Maintenance District No. 86-2, within the Upper Peters Canyon Specific Area (
Santiago Hills).The assessment will be increased 5% for this year. A second public hearing is
scheduled for August 10, 1993 at 3:00
P.M.NOTE: Letter of opposition received June 28, 1993 from Tuan A Nguyen, 383
N.
Fawnwood Lane.MAYOR BEYER OPENED THE
PUBLIC HEARING.The City Clerk announced the notice has been given in the manner and form as required
by law,and a Certificate of Compliance is on file and open for public inspection. One letter
in opposition had been received from Tuan
A Nguyen.The City Engineer provided a description of the boundaries of the District and
explained the extent of maintenance work. Council has chosen to have this area be maintained by
a private consultant. When the report was being prepared by Willdan & Associates, next year's
costs and costs for overruns were projected. As a result of this a deficit was
anticipated, and recommendation that a 5% tax increase be levied over and above next year. Since that
time there have been favorable bids on the landscape maintenance contract that resulted in a
cost savings.There will not be a deficit this year, so the 5% is not needed to make up
the difference.Amy Shepard, representing Willdan & Associates, 163 Donna Court, Anaheim,
reported the assessments: single family $312.03; multi-family $187.22; and mixed use $3,435.
75 an acre.Total expenditures for 1993/94 are estimated to be $454,000 for maintenance and $
6,000 for incidental expenses. The assessments to be raised for this year are $417,435 and
the rest will come from the reserve fund. There is no required reserve amount that needs
to be maintained.The City Engineer reported there is over $500,000 in reserves. However, all costs are
not in for the last fiscal year and projections
are being prepared.The
following people spoke:Javier Cuellar, 8215 E. White Oak Ridge, Unit III, commented the
maintenance of the landscaping has been above average and would like this high caliber
of maintenance retained.Ron Dietz, 8244 E. Hillsdale Dr., commented the residents in this area pay high taxes
and 5% is an impact and a negative force on property values. The reserve is now over twice
of what would be needed to maintain the district. According to Mr. Dietz's figures, $100,000 is
being asked over what is safely needed to run the maintenance. It can safely come down
and not significantly
impact the

Brian McCartney, 8238 E. Flowerwood, commented the increase may not be necessary. Mr.
McCartney addressed his comments to District 86-1 and the bonds that established this
district.There are currently $400,000 to $500,000 of excess funds available from the bond issue that
were not spent on landscaping and developing. When the bonds were issued in 1986 they could
be disposed of in one of three ways. One of them is to maintain the facility built in accordance
with the bonds themselves. It was proposed that Council investigate what it would take to
eliminate the assessment altogether for x number of years, if possible, and pay those assessments out
of those excess
proceeds.Bob Bennyhoff, 10642 Morada Dr., remarked landscaping will have to be maintained at
Rancho Santiago College, the new Albertson's market, medians on Jamboree and it is not known
what InterAmerican will
do.The City Engineer commented no private property is being maintained, but there is
still landscaping to be installed and included in the district when the work is completed.
Rancho Santiago College is paying for their share of the maintenance through the contract, but not as
a part of the assessment
district.It was recommended that modifications, with detailed figures, up-to-
date expenditures and revenue information, based on additional information, will be available at the
August 10, 1993 3:00 P.M. Session. These modification should also provide costs based on a
no
increase fee recommendation.Council suggested the need for a recommendation on a general policy for
reserves and what would be appropriate for these types of assessment districts. This policy should
include a more concise description of the landscape assessment account and what it includes, and
what needs to be done
in
the
future.

Zehner, 630 E. Culver, asked Council if they would consider Resolution 8199 within a two week
period rather than 30 days as previously approved by Council. Mr. Zehner is going out of town
in two weeks. The City Attorney and the Director of Community Development commented the
30 days is necessary to cover all aspects of Council's request.Carole
Walters, 534 N. Shaffer, announced she had discussed the traffic problem at Santiago Boulevard
and Brookside with Villa Park Mayor Bob Bell who will look into the problem.Page
