3-9-21 ADU Zone Change CITY OF ORANGE NOTICE OF PUBLIC HEARING ZONE CHANGE NO. 1302-21 NOTICE IS HEREBY GIVEN that the City Council of the City of Orange will hold a public hearing, Tuesday, March 9, 2021, at 6:00 p.m. or as soon thereafter as the matter may be heard, via teleconference, to consider the following request: SUBJECT: Zone Change No. 1302-21, Accessory Dwelling Unit Ordinance Amendment PROPERTY LOCATION: CITYWIDE REQUEST: An update to the accessory dwelling unit (ADU) provisions and other related provisions of the Orange Municipal Code is proposed in response to recent changes in state law. ENVIRONMENTAL INFORMATION: This project is statutorily exempt under the California Environmental Quality Act (“CEQA”) pursuant to Public Resources Code Section 21080.17 and Title 14, California Code of Regulations Section 15282(h) which exempts adoption of an ordinance regarding second units to implement provisions of Sections 65852.2 and 65852.22 of the Government Code. Additionally, this ordinance is categorically exempt pursuant to Sections 15303 (New Construction or Conversion of Small Structures) and 15305 (Minor Alterations in Land Use/Limitations). Similarly, the ministerial approval of accessory dwelling units and junior accessory dwelling units is not a “project” for CEQA purposes, and environmental review is not required prior to approving individual applications. APPLICANT: CITY OF ORANGE PLANNING COMMISSION ACTION: The Planning Commission conducted a public hearing on Zone Change 1302-21 on February 17, 2021, and recommended that the City Council approve the project by a vote of 5-0. All interested persons may submit comments and may be heard on any relevant matter relating to the proposed actions by mail, email, voicemail or in-person, as set forth in the March 9, 2021, City Council agenda.
