OPENING: 1.1 CALL TO ORDER: Chair Simpson called the meeting to order at 7:00 p.m. 1.2 FLAG SALUTE: Chair Simpson led the flag salute. 1.3 ROLL CALL: Present: Commissioners Simpson, Glasgow,Willits, Martinez and Vazquez 1.4 PUSLIC PARTICIPATION: Chair Simpson read the executive order and public comment process into the record. Chair Simpson opened public comment. Anna Pehoushek,Assistant Community Development Director stated no public coinments were received. 1.5 CONTINUED OR WITHDRAWN ITEMS: None 1.6 ASSISTANT COMMUNITY DEVELOPMENT DIRECTOR REPORTS: Anna Pehoushek,Assistant Community Development Director stated the City has initiated an update to the General Plan Housing Element and the document can be accessed on the City's website. There will be opportunities to participate in the public outreach process. 1.7 ANNOUNCEMENT OF THE APPEAL PROCEDURES (details found on the last page of this agenda) 2. Recommended Action: Adopt Planning Commission Resolution No. 27-20 entitled: A Resolution of the Planning Commission of the City of Orange recommending approval to the City Council of the City of Orange of a First Amendment to the Amended and Restated Development Agreement by and between the City of Orange and Orange County Health Authority (CalOptima) for the development project known as the"605 Building Site"located on the southeast corner of Lewis Street in City Park West. Robert Garcia, Senior Planner provided an overview of the extension request consistent with staff report. Chair Simpson opened the public hearing. Anna Pehoushek, Assistant Community Development Director stated no comments were received for this item. Chair Simpson closed public hearing. Commissioner Vazquez asked how the six-year extension was determined. Mr. Garcia stated that CalOptima had requested a total of six years based on its previous request. A motion was made to approve a Resolution of the Planning Cominission of the City of Orange recommending approval to the City Council of the City of Orange of a First Amendment to the Amended and Restated Development Agreement by and between the City of Orange and Orange County Health Authority of (CalOptima)for the development project known as the"605 Building Site"located on the southeast corner of Lewis Street in City Park West, CEQA exempt. Glassell Street. Recommended action: Adopt Planning Commission Resolution and No. 26—20 Entitled: A Resolution of the Planning Commission of the City Of Orange approving Conditional Use Permit No. 3085 — 19, Site Plan Review No. 0972 — 19, Design Review No. 4973 — 19, and Mitigated Negative Declaration No. 1866— 19 for the construction of a two-story, 30,133 square foot memory care facility at 574 S. Glassell Street. Kelly Ribuffo, Associate Planner provided an overview of the project consistent with the staff report. Alex Guerra, owner of the property spoke on behalf of the project. Don Preecha, Paulo Ayala, Trissa de Jesus Allen, Christy Cuba, Michael Green and Karen Nicholson were also available to answer questions. The Commissioners had questions and comments on the following: • Outreach to the neighboring Holy Cross Church. • Adequacy of overflow parking during special events. The Commissioners agreed to add a condition requiring the applicant to notify neighboring residents of any special events 10 days prior to its occurrence. • Reason for removal of pine trees in the driveway. • Type of connection between the two buildings. A motion was made to adopt Resolution No. 26-20 a Resolution of the Planning Commission of the City of Orange approving Conditional Use Permit No. 3085 —19,Maj or Site Plan Review No.0972—19,and Mitigated Negative Declaration No. 1866 — 19 for the construction of a two-story, 30,133 square foot memory care facility at 574 S. Glassell Street — with an additional condition regarding special events. Public Hearing: Conditional Use Permit No. 3041-17,Variance No.245-17, Design Review No. 4901-17, Minor Site Plan Review No. 0899-17, and Environmental Review No. 1854-17 -Holy Sepulcher Cemetery Maintenance Facility Recommended Action: Adopt Planning Commission Resolution No. PC 25-20 entitled: A Resolution of the Planning Commission of the City of Orange approving Conditional Use Permit No. 3041-17,Variance No. 2245-17,Design Review No. 4901-17, Minor Site Plan Review No. 0899-17, and Environmental Review No. 1854-17 to demolish an existing maintenance building and associated service yard and replace it with a new one-story maintenance facility, located on the northerly one-acre vacant parcel adjacent to the Holy Sepulcher Cemetery at 7751-7845 E. Santiago Canyon Road. Monique Schwartz,Associate Planner provided an overview of the project consistent with the staff report. Chair Simpson and Commissioner Willits disclosed that they met with Mr. Sennett,toured the site, and spoke with Laura Thomas on the telephone. Commissioner Glasgow disclosed that he met with Mr. Bennett and toured the site. Commissioner Martinez stated that he walked the property. Page 4 of 6 ,: � Planning Agenda October 19, 2020 Kevin Jennier,project manager for the Roman Catholic Diocese of Orange and (w/conditions) Jaines Mickartz, architect spoke on behalf of the project. Mr. Jennier stated for the record, that the building location is exactly as proposed on the plans and that it has not changed. They also responded to the comments and concerns of Mr. Bennett and the OPA. Commissioner questions and comments: • The new elevation is only 2 inches higher than the original proposal from 2008. • Building setback to Mr. Bennett's property. • Purpose of the easement. Mr. Mickartz responded that the easement is maintained and provided for the Orange County Flood Control District and the Fire Department. • The new trail on the west side has been moved up to the new entrance at the traffic signal and horse-crossing trail. • Clarification regarding the dog leg in Exhibit 2. • The proposed gate and fence,rather than bollards, is an improvement to help prevent runaway horses onto East Santiago Canyon Road. Does OPA concur? • Mr. Jennier advised the Commissioners that the proposed gate would need to be approved by the Flood Control District and the Fire Department. • How will the trail be secured if the gates are not approved by the Orange County Flood Control District and the Fire Department? • Has noise froin the maintenance vehicles been evaluated? • Will additional uses be conducted in the maintenance yard? • Will the trail have any asphalt, or will it be all dirt?Mr. Jennier stated the Flood Control District requires the asphalt easement be maintained. • Have the new plans been reviewed by all the other departments? • Ms. Schwartz explained condition four in the resolution allows for substantial confonnance; therefore, if the plans are similar to and in substantial conformance with the intent of the approval, the Community Development Director can approve the revised plans. • The Commission agrees with the proposed improvements,that the project fits in the neighborhood, complies with Code, and shows that the Diocese listened to �PA. • If the lot had been maintained and sold as a residential lot, an unfavorable project could have been proposed. Chair Simpson asked staff to read the public coinments into the record. Ms. Pehoushek read a letter of opposition froin Doug Bennett. A motion was made to adopt Planning Commission Resolution No. PC 25-20 a Resolution of the Planning Commission of the City of Orange approving Conditional Use Permit No. 3041-17, Variance No. 2245-17, Design Review No. 4901-17, Minor Site Plan Review No. 0899-17, and Environmental Review No. 1854-17 to demolish an existing maintenance building and associated service yard and replace it with a new one-story maintenance facility, located on the northerly one-acre vacant parcel adjacent to the Holy Sepulcher Cemetery at 7751-7845 E. Santiago Canyon Road with a condition for a new gate system and horse trail on the northwest side of the property per Exhibit 2.
