RES-ORA-0400 Tax Allocation For Redevelopment Project AreaRESOLUTION NO. ORA- 0400 A RESOLUTION OF THE ORANGE REDEVELOPMENT AGENCY FINDING THAT THE USE OF TAXES ALLOCATED FROM THE ORANGE MERGED AND AMENDED REDEVELOPMENT PROJECT AREA FOR THE PURPOSE OF INCREASING, IMPROVING, AND PRESERVING THE COMMUNITY'S SUPPLY OF LOW AND MODERATE INCOME HOUSING OUTSIDE THE ORANGE MERGED AND AMENDED REDEVELOPMENT PROJECT AREA WILL BE OF BENEFIT TO THE ORANGE MERGED AND AMENDED REDEVELOPMENT PROJECT AREA WHEREAS, the Orange Redevelopment Agency ("Agency") has undertaken steps to amend and merge the Redevelopment Plans for the Tustin Street Original. Tustin Street Amendment No.1, Southwest Original, Southwest Amendment No.1, Southwest Amendment No.2, Southwest Amendment No.3, and Northwest Redevelopment Projects ("Orange Merged and Amended Redevelopment Project Area"); and WHEREAS, the Agency is required to complete the actions prescribed by Sections 33354.6 and 33485 through 33489 of the California Community Redevelopment Law, Health and Safety Code Section 33000 et seq. ("CRL"); and WHEREAS, the Agency has prepared a draft Amended and Restated Redevelopment Plan for the Orange Merged and Amended Redevelopment Project Area that would result in the allocation of taxes from the Orange Merged and Amended Redevelopment Project Area to the Agency for the purposes of redevelopment; and WHEREAS, Section 33334.2 of the CRL requires that not less than 20 percent (20%) of all taxes so allocated be used by the Agency for the purpose of increasing, improving, and preserving the community's supply oflow and moderate income housing available at affordable housing cost; and WHEREAS, Section 33334.2 of the CRL provides that the Agency may use such funds outside the Orange Merged and Amended Redevelopment Project Area if a finding is made by resolution of the Agency and City Council of the City of Orange that such use will be of benefit to the Merged and Amended Redevelopment Project Area; and WHEREAS, the Orange Merged and Amended Redevelopment Project Area contains little or no vacant land zoned for residential uses, and limited property suitable for low and moderate income housing.Q:\CityClerk\Resolulions\ORA-0400-Projecl Area NOW, THEREFORE, the Orange Redevelopment Agency does hereby resolve as follows: Section I. The use of taxes allocated from the Orange Merged and Amended Redevelopment Project Area for the purpose of increasing, improving, and preserving the community's supply of low and moderate income housing available at affordable housing cost outside the Orange Merged and Amended Redevelopment Project Area will be of benefit to the Orange Merged and Amended Redevelopment Project Area.
