0398 A RESOLUTION OF THE
ORANGE REDEVELOPMENT AGENCY APPROVING
THE PRELIMINARY REPORT, DRAFT AMENDED
AND RESTATED REDEVELOPMENT PLAN,
DRAFT RULES GOVERNING PARTICIPATION
AND REENTRY PREFERENCES FOR
PROPERTY OWNERS, OPERATORS OF BUSINESSES
AND BUSINESS TENANTS, AND DRAFT METHOD
OF RELOCATION IN CONNECTION WITH
THE PROPOSED AMENDMENTS TO AND MERGER
OF THE EXISTING REDEVELOPMENT
PROJECT
AREAS WHEREAS, the Orange Redevelopment Agency ("Agency") has undertaken steps
to amend and merge the Redevelopment Plans for the Tustin Street Original, Tustin
Street Amendment No. I, Southwest Original, Southwest Amendment No. I. Southwest
Amendment No.2, Southwest Amendment No.3, and Northwest Redevelopment Projects ("Orange
Merged and Amended Redevelopment Project Area");
and WHEREAS, the Agency is required to complete the actions prescribed by
Sections 33354.6 and 33485 through 33489 of the California Community Redevelopment Law,
Health and Safety Code Section 33000 et seq. ("CRL");
and WHEREAS, the Agency has prepared a draft Amended and Restated
Redevelopment Plan for the Orange Merged and Amended Redevelopment Project Area in accordance with
the requirements ofthe CRL ("Redevelopment Plan");
and WHEREAS, Section 33345 of the CRL requires the Agency to adopt and make
available for public inspection rules to implement the operation of owner participation in connection
with a redevelopment plan;
and WHEREAS, the Agency has prepared draft Rules Governing Participation and
Reentry Preferences to Property Owners, Operators of Businesses and Business Tenants ("
Owner Participation Rules") for the Orange Merged and Amended Redevelopment Project Area
for public inspection;
and WHEREAS, Section 33411 of the CRL requires the Agency to prepare a feasible
method or plan for relocation for families and persons to be temporarily or permanently displaced
from housing facilities in the project area, and for nonprofit local community institutions to
be temporarily or permanently displaced from facilities actually used for institutional purposes
in the project area ("Method of Relocation");

WHEREAS, the Agency has prepared a draft Method of Relocation pursuant to Section
33411 of the CRL; and
WHEREAS, Section 33328 of the CRL provides that prior to the publication of the
notice of the joint public hearing of the Agency and the City Council of the City of Orange
City Council") on the proposed Redevelopment Plan, the Agency shall consult with each
affected taxing agency with respect to the proposed Redevelopment Plan; and
WHEREAS, Section 33344.5 of the CRL, the Agency has prepared the Preliminary
Report on the proposed Redevelopment Plan for the Orange Merged and Amended
Redevelopment Project Area ("Preliminary Report") for transmittal to the affected taxing
agencies.
NOW, THEREFORE, the Orange Redevelopment Agency does hereby resolve as
follows:
Section 1. The Agency hereby approves the Preliminary Report, the Draft
Redevelopment Plan, the Draft Owner Participation Rules, and the Draft Method of Relocation
presented to the Agency at this meeting and directs these documents to be available for public
inspection in the office of the City Clerk, substantially in the form and content presented to the
Agency. The Agency staff and the Agency's redevelopment consultant are hereby authorized to
make such modifications to the foregoing as may be necessary or appropriate in the
circumstances.
Section 2. The Agency hereby authorizes and directs staff to transmit the Draft
Redevelopment Plan and the Preliminary Report to the affected taxing agencies in accordance
with the provisions of the CRL.
Section 3. The Agency hereby authorizes and directs Agency staff to consult with the
affected taxing agencies with respect to the draft Redevelopment Plan and the allocation of taxes
pursuant to Section 33670 of the CRL.
