RESOLUTION OF THE ORANGE REDEVELOPMENT
AGENCY REAFFIRMING THE PREVIOUSLY
ADOPTED PRELIMINARY PLANS FOR
THE SOUTHWEST ORIGINAL, SOUTHWEST AMENDMENT
NO.1, SOUTHWEST AMENDMENT NO.
2, SOUTHWEST AMENDMENT NO.3, TUSTIN STREET
ORIGINAL, TUSTIN STREET AMENDMENT
NO. 1 AND NORTHWEST REDEVELOPMENT
PROJECT AREAS AND COMMENCING
AMENDMENT AND MERGER ACTIVITIES
WHEREAS,
the Planning Commission of the City of Orange, hereinafter referred to as Planning
Commission," adopted and the Orange Redevelopment Agency, hereinafter referred to as "
Agency." approved the Preliminary Plan for the Southwest Original Redevelopment Project on
August 6,1984, and August 14, 1984, respectively; and WHEREAS,
the Planning Commission adopted and the Agency approved the Preliminary
Plan for Amendment NO.1 to the Southwest Redevelopment Project on October 21,1985,
and October 22, 1985, respectively; and WHEREAS,
the Planning Commission adopted and the Agency approved the Preliminary
Plan for Amendment No.2 to the Southwest Redevelopment Project on September 21,
1987, and October 20, 1987, respectively; and WHEREAS,
the Planning Commission adopted and the Agency approved the Preliminary
Plan for Amendment No.3 to the Southwest Redevelopment Project on January 15,1996,
and January 23,1996, respectively; and WHEREAS,
the Planning Commission adopted and the Agency approved the Preliminary
Plan for the Tustin Street Original Redevelopment Project on August 8, 1983, and August
16, 1983, respectively; and WHEREAS,
the Planning Commission adopted and the Agency approved the Preliminary
Plan for Amendment No. I to the Tustin Street Redevelopment Project on September
21,1987, and October 20,1987. respectively; and WHEREAS,
the Planning Commission adopted and the Agency approved the Preliminary
Plan for the Northwest Redevelopment Project on September 29, 1987, and October 20,
1987, respectively; and
WHEREAS, these Preliminary Plans were adopted pursuant to the requirements of the
California Community Redevelopment Law, Health and Safety Code Section 33000, et seq.
CRL"); and
WHEREAS, Article 16 of Chapter 4 of the CRL (Sections 33485 through 33489) allows
merging of existing redevelopment project areas by amending the redevelopment plans for each
project area; and
WHEREAS, the Agency wishes to merge the Southwest Original, Southwest
Amendment No. I, Southwest Amendment No.2, Southwest Amendment No.3, Tustin Street
Original, Tustin Street Amendment No. I and the Northwest Redevelopment Project Areas,
hereinafter referred to as the "Project Areas," pursuant to Article 16 of the CRL; and
WHEREAS, the Agency proposes to amend both the time limit to incur indebtedness,
pursuant to Sections 33333.6(a) and 33333.2(a) of the CRL, and the eminent domain time limit
within the Project Areas in connection with the proposed merger by following the requirements
of Section 33354.6 of the CRL; and
WHEREAS, the Agency desires to reaffirm the previously adopted preliminary plans in
order to commence the process of amending and merging the redevelopment plans for the Project
Areas.
NOW, THEREFORE, the Orange Redevelopment Agency does hereby resolve as
follows:
SECTION I:
The Agency hereby reaffirms the previously adopted preliminary plans for the Southwest
Original, Southwest Amendment No. I, Southwest Amendment No.2, Southwest Amendment
No.3, Tustin Street Original, Tustin Street Amendment No. I and the Northwest Redevelopment
Project Areas.
SECTION II:
The Agency directs the Executive Director of the Agency to prepare the required
documents and complete the actions prescribed by CRL Sections 33485 through 33489 and
33354.6.
