A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE SUMMARILY VACATING A
PORTION OF THE EAST SWE OF ORANGE PARK
BOULE V ARD, SOUTH OF JOSHUA TREE AVENUE
FOR STREET PURPOSES, RESERVING AND
EXCEPTING AN EASEMENT FOR ANY AND ALL
EXISTING UTILITIES.
WHEREAS, the City Council wishes to vacate a portion of the east side of Orange Park
Boulevard, south of Joshua Tree Avenue for street purposes; and
WHEREAS, the portion of street to be vacated is specifically described in the attached
legal description and map; and
WHEREAS, this summary vacation of stre<:ts and public service easemcnt is conducted
pursuant to Division 9, Part 3, Chapter 4 of the Streets and Highways Code, Sections 8330 et
seq.; and
WHEREAS, this vacation meets all of the requirements for a summary vacation of
stre:ets and public service easements under said Cod,~.
NOW THEREFORE, the City Council of the City of Orange declares as follows:
I. That this summary vacation is made pursuant to Division 9, Part 3, Chapter 4 of
the Streets and Highways Code, Section 8330 et seq.
2. That the easement for street purpos'~s to be summarily vacated is that easterly
portion of Orange Park Boulevard, located south of Joshua Tree Avenue, as more particularly
described in Exhibit A and depicted in Exhibit B, which are attached hereto and incorporated
herein by thi s reference.
3. That the City reserves and excepts from such vacation all existing easements
granted for utility purposes, and reserves any rights necessary to maintain, operate, replace,
remove or renew such public utilities.
4. That the portion of Orange Park Boulevard to be summarily vacated is excess
right of way not required for right of way purposes.
5. That the street to be sumrnarily vacated has been impassable to vehicular travel
for a period of more than five consecutive years and no public money has been expended for
maintenance during such period.
6. That the street to be summarily vacated is unnecessary for present or prospective
public use because Orange Park Boulevard has been realigned to its present configuration.
7. That from and after the date this Resolution is recorded the street vacated shall
no longer constitute a public street.
8. That the City Clerk is directed to cause a certified copy of this Resolution to be
recorded in the office of the Orange County Recorder.
