A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ORANGE RESCINDING AND REPEALING
RESOLUTION NO. 9778, WHICH AMENDED THE CITY'S
GENERAL PLAN ON A llO-ACRE SITE TO PERMIT
THE DEVELOPMENT 01<' A PROJECT PROPOSED
BY FIELDSTONE
COMMUNITIES.WHEREAS, on October 14, 2003, by a 3-2 vote the City Council
adopted Resolution No. 9778, which amended General Plan designations on a 11 O-acre site
generally bordered by the Mabury Ranch residential development to the north, Santiago Canyon Road
to the south,The Reserve residential development to the east and Cannon Street to
the west; and WHEREAS, opponents of the project circnlated referendum petitions
calling for the City Council's approval of the general plan amendments to be put to
the voters: and WHEREAS, the Registrar of the County of Orange has verified that 5,
847 of the registered voters in the City of Orange have signed the
referendum petitions; and WHEREAS, Elections Code Section 9237 requires the City
Council to reconsider Resolution No. 9778 in light of the signatures that have
been gathered; and WHEREAS, Elections Code Section 92] 5 requires the City Council
to either repeal Resolution No. 9778 or to submit it to
the voters; and WHEREAS, it is in the best interest of the City and its citizens to
avoid the costly expense of ordering a special election (approximately $60,000), especially givm the
fact that a signlificant number of persons (at least 5,847) voting at the last generalelection have

the referendum petitions.NOW, THEREFORE, THE CITY COUNCIL OF THE
CITY OF ORANGE DOES RESOLVE, DECLARE, DETERMINE AND
ORDER AS FOLLOWS:Section 1: That Resolution No. 9778 is repealed in its entirety.
The City Council directs City staff to come back with a report on any additional actions it
deems necessary or prudent as a result
of this action.ADOPTED this 25th day
