A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ORANGE ESTABLISHING PARKING TIME LIMITS
ON PLAZA SQUARE AND CERTAIN STREETS SERVING
THE CENTRAL PUBLIC SQUARE AND CIRCULAR
PLAZA AT GLASSELL STREET AND CHAPMAN
AVENUE; AMENDING AND REVISING THE MASTER
SCHEDULE OF FEES AND CHARGES AS AUTHORIZED
BY ORANGE MUNICIPAL CODE CHAPTER 3.10; AND
MAKING CERTAIN FINDINGS RELATED THERETO.
WHEREAS, Chapter 10.30 of the Orange Municipal Code regulates those areas in the
City which are subject to the Neighborhood Parking Permit Program, including permit parking
on ffilmicipal parking lots serving the central public square and circular plaza at Glassell Street
and Chapman Avenue (the Plaza); and
WHEREAS, by the adoption of Ordinanee No. 19-03, the City Council has
determined that it is more efficient to remove from Chapter10.30 of the Orange Municipal Code
the specific fees for permit parking in certain municipal parking lots serving the Plaza and to
allow for such fees to be set forth in the City's Master Schedule of Fees and Charges;
and WHEREAS, the City Council desires to set forth the fees for permit parking in
certain municipal parking lots serving the Plaza in accordan(:e with the authority contained in
Chapter 10.30;
and WHEREAS, Section 22507 of the California Vehicle Code and Section 10.34.010
of the Orange Municipal Code authorize the City Council to establish by motion or
resolution parking limits on various streets in the City during certain hours of the day;
and WHEREAS, the City Council desires to restrict the stopping, parking or standing
of vehicles on Plaza Square and certain streets serving the Plaza, as described hereinbelow,
during certain hours of the day;
and WHEREAS, Section 22519 of the Caliifornia Vehicle Code and Sections10.42.
040 through10.42.070 of the Orange Municipal Code authorize the City Council to establish
by motion or resolution parking limits on certain parking lots owned and controlled by the
City during certain hours of the day;
and WHEREAS, the City Council desires to restrict the stopping, parking or standing
of vehicles on those parking lots owned and controlled by the City and described
hereinbelow during certain hours of the day;
WHEREAS, on June 12, 1984, the City Council adopted Resolution No. 6100 which
implemented the Master Schedule of Fees and Charges; and
WHEREAS, the Master Schedule of Fees and Charges has been revised from time to
time by the City Council; the last time being April 22, 2003, when Resolution No. 9722 was
adopted by the City Council; and
WHEREAS, the City Council has determined that the Master Schedule of Fees and
Charges should again be amended to provide for certain fees relating to permit parking on
cel1:ain municipal parking lots serving the Plaza, which represent not more than the true cost of
providing the parking facilities and services provided by the City in connection with such fees;
and
WHEREAS, the City Council finds that the approval of fees for permit parking
authorized by this ordinance is exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15272 of the State CEQA Guidelines because the fees to be collected are
necessary to maintain the municipal parking lots serving the Plaza; and
WHEREAS, the City Council finds that the modification of the time limits for parking of
vehicles on Plaza Square and certain streets serving the Plaza, as described hereinbelow, falls
within that class of projects which will not cause a significant effect on the enviroument and is
exempt .from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the
State CEQA Guidelines because such action involves negligible or no expansion of use of the
streets beyond that previously existing.
NOW, THEREFORE BE IT RESOL VEl> by the City Council of the City of Orange
as follows:
I. The City Council finds and deternlines that the foregoing recitals are true and correct.
2. There will be two hour parking between the hours of 8:00 a.m. and 7:00 p.m., except
for Sundays and holidays, for all parking spaces on Plaza Square.
3. There will be two hour parking between the hours of 8:00 a.m. and 7:00 p.m., except
for Sundays and holidays, for all parking spaces on the north and south sides of Chapman
Avenue from Grand Street to Lemon Street.
4. There will be two hour parking between the hours of 8:00 a.m. and 7:00 p.m., except
for Sundays and holidays, for all parking spaces on the east and west sides of Glassell Street
from Almond Avenue to Maple Avenue.
5. There will be two hour parking between the hours of9:00 a.m. and 6:00 p.m., except
for Sundays and holidays, for all parking spaces on the east and west sides of Orange Street a
distance of 120 feet south from its intersection with Chapman Avenue.
6. There will be two hour parking between the hours of9:00 a.m. and 6:00 p.m., except
for Sundays and holidays, for all parking spaces on the east and west sides of Orange Street a
distance of 100 feet north from its intersection with Chapman Avenue.

7. There will be two hour parking between the hours of9:00 a.m. and 6:00 p.m., except
for Sundays and holidays, for all parking spaces on the south side of Maple Avenue
immediately adjacent to the real property commonly known as 108 through 116 East Maple
Avenue.
8. There will be two hour parking between the hours of9:00 a.m. and 6:00 p.m., except
for Sundays and holidays, for all parking spaces on the west side of Orange Street a distance of
80 feet south of its intersection with Maple Avenue.
9. There will be three hour parking between the hours of 6:00 a.m. and 6:00 p.m.,
except for Sundays and holidays, for all parking spaces, other than those parking spaces
designated by the City Traffic Engineer for permit parking pursuant to Section 10.30.030 of the
Orange Municipal Code, in the following parking lots owned and under the control of the City:
1. The southwest comer of Orange Street and Maple A venue;
2. The southeast corner of Olive Street and Maple Avenue;
3. On South Grand Street between 124-142 South Grand Street and 230
E.Chapman
Avenue;4. The 100 block of South Orange
Street;5. The 100 block of North Orange
Street;6. On the east and west sides of the 100 block of South Olive Street;
and 7. The 100 block of North Olive
Street.10. The Master Schedule of Fees and Charges is hereby amended and the attachment
to this Resolution entitled, Additions to the Cum:nt Master Schedule of Fees and Charges,
is hereby adopted, amending, supplementing and modifying the Master Schedule of Fees
and Charges to provide for the inclusion of the amount of fees for permit parking in
certain municipal parking lots serving the Plaza, which fees more particularly described on
said
attachment.11. The City Council finds that the fees and charges set forth in the attached,
Additions to the Current Master Schedule of Fees and Charges, do not exceed the reasonable costs
of providing the parking facilities and services pertaining to each
fee.12. The fees, charges, and rates listed in the attached, Additions to the Current
Master Schedule of Fees and Charges, shall be effective as of the effective date of Ordinance No.

03.13. If any fee, charge, or rate set forth in this Resolution or the application thereof
to any person or circumstance is held to be unconstitutional or otherwise invalid by any court
of competent jurisdiction, such invalidity shall not affect any other fee, charge, or rate,
or application thereof, which can be implemented without the invalid fee, charge, or rate,
or application thereof, and to this end the fees, charges and rates of this Resolution are declared
to be
severable.
14. Be it further resolved that the parking time limits established in this Resolution
shall become effective once those streets have been posted showing the time limits established
in this Resolution but not, in any event, sooner than that date which is thirty (30) days following
the date of final passage of Ordinance No. 19-
