RES-9722 Revising Master Schedule of Fees & ChargesRESOLUTION NO. 9722 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING AND REVISING THE MASTER SCHEDULE OF FEES AND CHARGES AS AUTHORIZED BY ORANGE MUNICIPAL CODE CHAPTER 3,10, WHEREAS, on June 12, 1984, the City Council adopted Resolution No. 6100 which irnplernented the Master Schedule of Fees and Charges, consisting of Schedule A and Schedule B; and WHEREAS, the Master Schedule of Fees and Charges has been revised frorn tirne to tirne by the City Council; the last tirne being June 13,2000, when Resolution No. 9296 was adopted by the City Council; and WHEREAS, the City Council hereby finds and determines that the Master Schedule of Fees and Charges should be revised in order to reflect the true cost of providing the respective goods, facilities, and services provided by the City in connection with such fees. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Orange as follows: 1. Resolution No. 9296, adopted June 13,2000, and all arnendrnents thereto, are hereby repealed and replaced in their entirety with the attached Master Schedule of Fees and Charges. 2. The City Council finds that the fees and charges set forth in the attached Master Schedule of Fees and Charges do not exceed the reasonable costs of providing the respective goods, facilities and/or services pertaining to each fee and charge. 3. The fees, charges, and rates listed in the attached Master Schedule of Fees and Charges shall be and becorne effective as of April 28, 2003. 4. If any fee, charge, or rate set forth in this Resolution or the application thereof to any person or circurnstance is held to be unconstitutional or otherwise invalid by any court of cornpetent jurisdiction, such invalidity shall not affect any other fee, charge, or rate, or application thereof, which can be irnplernented without the invalid fee, charge, or rate, or application thereof, and to this end the fees, charges and rates of this Resolution are declared to be severable. Time spent by City staff to complete the project will be charged against the posted deposit. Additionally, any amounts incurred by the City for outside consultants including but not limited to legal counsel will be charged to the applicant. The rate charged for these services is as follows: Any City Staff Administrative Overhead Charge Current Billable Hourly Rate Per Cost Allocation Plan Should the applicant desire that one, or more, services are perfotmed on a single major project a deposit will be required to be posted by the applicant. The amount of the deposit will be determined at project initiation. The deposit will be based upon the estimated number of hours required to eomplete the entire project multiplied by the hourly rate(s) for the staffperson(s) involved in the project. Deposits for Development Agreement Fees shall be calculated as above and shall be made separate from all other deposits. When more than 50% of the deposit has been credited toward hourly services provided, the applicant will be billed direetly for actual time spent on the project. At the completion of a major project, a final accounting of deposits posted and amounts charged toward the project will be calculated and any charges due the City or refunds due the applicant will be processed. The billable hourly rates established for City staff will be adjusted periodically for any changes in rate of payor benefits afforded City staff. These rates will be updated as benefit changes are negotiated and approved by City Council as prepared and approved by the City Manager. An Administrative Overhead Charge will be added to all projects requiring the use of an outside consultant or contract employee to eover the indirect and administrative costs associated with the contract. 35
