A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE AUTHORIZING THE
DISPOSITION, ACQUISITION AND
ABANDONMENT OF STREET RIGHT-
OF-WAY WITHOUT MAKING
GENERAL PLAN
CONSISTENCY FINDINGS.WHEREAS, Govemment Code Section 65402 provides that prior to
disposing of any property or abandoning or vacating any street, the planning agency of the
city seeking to dispose, abandon or vacate such property must make a finding that such
disposition is consistent with the adopted general
plan; and WHEREAS, Government Code Section 65402 provides that the City
Council may adopt a resolution making this requirement inapplicable to
certain acquisitions,dispositions and abandonment of property for street
purposes; and WHEREAS, the City Council of the City of Orange finds that requiring
a finding of general plan consistency for such minor acquisitions, dispositions
and abandonment does not further the
public interest.NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of Orange
as follows:
Section 1.to
the following:The provisions of Government Code Section 65402 shall
not apply 1. The disposition of the remainder of a larger parcel acquired and used
in part for stn:
et purposes.2. Acquisitions, abandonment and dispositions for
street widenings.3. Alignment projects, provided such dispositions,
acquisitions or abandonment are of a
minor nature.Section 2.This policy shall be placed in the City's
ADOPTED this 22nd day of April, 2003.
