A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE STATING ITS INTENT TO
VACATE A PORTION OF THAT PUBLIC STREET
COMMONLY KNOWN AS UNIVERSITY DRIVE
GENERALLY LOCATED EAST OF AND
ADJACENT TO GLASS ELL STREET, SETTING A
PUBLIC HEARING THEREON, AND DIRECTING
NOTICE THEREOF TO BE POSTED AND
PUBLISHED.
WHEREAS, upon the request of Chapman University, a California non-
profit corporation, the City Council of the City of Orange declares its intent to vacate that portion
of University Drive generally depicted on the map attached hereto as Exhibit B and
more particularly described on Exhibit A, which is a public street and right-of-way
located east of and adjacent to Glassell Street at the proposed University Drive entry
to the Chapman
University campus; and WHEREAS, the City Council intends to reserve and except from such
vacation: (1) all existing easements for public utility facilities line purposes and any right
necessary to maintain,operate, replace, remove or renew such public utilities or other
public improvements underlying the subject easement, including, but not limited to, traffic detector loops
and control devices;and (2) the easement and right at any time, or from time to time, to
constlUct, maintain, operate,replace, remove, and renew sanitary sewers and storm drains and
appurtenant stlUctures in,upon, over, and across that portion of University Drive proposed to be vacated
and, pursuant to any existing franchise or renewals thereof, or otherwise, to constlUct,
maintain, operate, replace,remove, renew, and enlarge lines of pipe, conduits, cables, wires, poles,
and other convenient stlUctures, equipment, and fixtures for the operation of gas pipelines,
telegraphic and telephone lines, and for the transportation or distribution of electric energy and water,
and for incidental purposes, including access to protect these works from all hazards in, upon,
and over those portions of University Drive proposed to
be vacated; and WHEREAS, the vacation of that portion of University Drive for
public road and highway purposes is conducted pursuant to the Public Streets,
Highways, and Service Easements Vacation Law (Division 9, Part 3, Chapter 3 of the Streets
and Highways Code,commencing at
Section 8300); and WHEREAS, a hearing for all persons interested in the proposed vacation
shall be held on September 14, 2004 at 4:30 p.m. in the Council Chambers of the City of
Orange, 300 E.Chapman Avenue, Orange, California, or as soon thereafter as the matter
NOW, THEREFORE the City Clerk is hereby directed to publish and post this
resolution of intention in the manner required by Sections 8322 and 8323 of the Streets and
Highways Code of the State of California.
