RES-9864 Certifying Final Environmental Impact Report Del RioRESOLUTION NO. 9864 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE CERTIFYING THE ADEQUACY OF FINAL ENVIRONMENTAL IMPACT REPORT NO. 1720-03 AND ADOPTING FINDINGS OF FACT AND MITIGATION MONITORING AND REPORTING PROGRAM FOR THE DEVELOPMENT OF A PLANNED COMMUNITY ON 73 ACRES BY THE DEL RIO, LLC, INCLUDING ASSOCIATED APPLICATIONS FOR GENERAL PLAN AMENDMENT 2004-0002, ZONE CHANGE 1222- 03 AND A DEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF ORANGE AND DEL RIO, LLC.APPLICANT: DEL RIO, LLC WHEREAS, in compliance with the California Environmental Quality Act (CEQA)California Public Resources Code Sections 21000 et seq.) and the State CEQA Guidelines California Code of Regulations Section 15000 et seq.) the City, acting as lead agency, has prepared Final Environmental Impact Report No. 1720-03, State Clearing House No. 99061122 for the applications submitted by Del Rio, LLC (hereinafter collectively referred to as the Project) consisting of a request for:General Plan Amendment 2004-0002 amending the land use map to change existing General Plan land use designations of the Project area from Resource Area to Open Space-Park, Open Space, Low Medium Density Residential and Medium Density Residential.Zone Change No. 1222- 03 establishing a PC (Planned Community) zoning designation and adopting the Del Rio Development Plan for approximately 73 acres to be annexed from the County of Orange.Approval of a Development Agreement by and between the City of Orange and Del Rio, LLC.Application by the City of Orange to LAFCO for annexation proceedings.WHEREAS, Final Environmental Impact Report No. 1720-03 (hereinafter the FEIR)evaluates the potential adverse environmental effects of the Proj ect; and WHEREAS, in accordance with Section 15132 of State CEQA Guidelines the FEIR consists of:a. b. Draft Environmental Impact Report Technical Appendices A thlOugh M, dated July 15, 2003; c. Recirculated Portion of Draft EnvilOnmenta1 Impact Report, dated December 11,2003. d. Final Environmental Impact Report, dated March 25, 2004.; e. Final Environmental Impact Report Technical Appendices A through H; f. Mitigation Monitoring and Reporting PlOgram, dated March 25, 2004; g. All attachments, incorporations, and references to the documents delineated in items a. through f. above and submitted to the City a.s part of the plOceedings relating to the Project. WHEREAS, in accordance with State and local law, on April 5, 2004, the Planning Commission conducted a duly noticed public hearing on the Project, considered information presented by City staff and public testimony regarding the Project, and recommended approval of the FEIR and the Project; and WHEREAS, in accordance with State and local law, on May 11, 2004, the City Council conducted a duly noticed public hearing on the PlOject, reviewed the FEIR and the PlOject, and considered information presented by City staff and public testimony regarding the PlOject; and WHEREAS, pursuant to Section 21081 of CEQA and Section 15091 of the CEQA Guidelines, prior to approval of the Project for which an EIR has been prepared and identified one or more significant envilOnmental effects of the Project, the decision making body must make one or more of the findings set forth in Section 21081 of CEQA, together with a statement of facts in support of each finding; and WHEREAS, the City has prepared and the City Council has reviewed draft Findings of Facts for the PlOject, which should be adopted if the City approves the Project; and WHEREAS, Section 21091.6 of CEQA requires that where an EIR has been prepared for a project for which mitigation measures are adopted, that a mitigation monitoring or reporting program be adopted for said project; and WHEREAS, the City has prepared and the City Council has reviewed the Mitigation Monitoring PlOgram, dated March 25, 2004, which should be adopted if the City Council applOves the Proj ect. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF ORANGE FINDS AND DECLARES AS FOLLOWS: 1. The FEIR was presented to the City Council and the City Council has carefully reviewed and considered the information contained in the FEIR prior to taking action on the PlOject. 2 2. The FEIR contains an adequate and complete assessment of the potential environmental impacts ofthe Project. 3. The FEIR was considered prior to approval of the Project and is found and determined to adequately address all potential adverse environmental impacts of the Project, and serves as an adequate and appropriate environmental docwnentation for the Project. 4. The City Council certifies and finds that the FEIR and all required notices, have been completed in compliance with CEQA and the CEQA Guidelines, and that the City Council has considered all of the comments received on the FEIR during the public review process, as well as the responses to comments. 5. The City Council finds and certifies that the FEIR reflects the independent judgment and analysis of the City of Orange, as the lead agency for the Project. 6. The City Council hereby approves, finds and certifies that the FEIR has been completed in compliance with the requirements of CEQA, the CEQA Guidelines, and the City's Environmental Analysis Project; and the City Council, having final review authority over the Project, certifies the FEIR as complete and adequate under CEQA, the CEQA Guidelines and the City's Environmental Analysis Project. 7. The FEIR identifies certain significant effects that would result if the Project were approved. However, all of these significant environmental effects can be avoided or mitigated to a level of insignificance by the imposition of the mitigation measures in the FEIR incorporated herein by this reference as though set forth in full and as described in the Findings of Facts attached hereto as Exhibit A and incorporated herein by this reference. Potential mitigation measures and Project alternatives not incorporated into the Project were rejected as infeasible, based upon specific economic, social or other considerations as set forth in the Findings of Facts. 8. It adopts the Mitigation Monitoring and Reporting Program attached hereto as Exhibit B and incorporated herein by this reference, finding that it establishes a mechanism and procedures for implementing and verifying the implementation of and compliance with the Project design features, standard conditions and mitigation measures pursuant to Public Resources Code Section 21081.6. 9. That its decision to certify the FEIR, adopt the Findings of Facts, and approve the Project is based upon the record of the proceedings, the custodian of which is the City Clerk of the City of Orange, 300 E. Changes or alterations have been required in, or incorporated into, the project, which mitigate or avoid the significant effects on the environment.b. Those changes or alterations are within the responsibility and jurisdiction of another public agency and have been, or can and should be, adopted by that other agency.c. Specific economic, social, or other considerations make infeasible the mitigation measures or project alternatives identified in the final environmental impact report."Because the Del Rio Development Plan Environmental Impact Report (EIR) identified significant effects that may occur as a result of the projcct, and in accordance with the provisions of CEQA and CEQA Guidelines, the City of Orange hereby adopts these findings as part of the '~pproval of the project and related applications.The City of Orange has prepared a Project EIR for the project in accordance with CEQA and CEQA Guideline requirements. The EIR was subject to review, and the Department of Community Development recommended its certification to the City of Orange Planning Commission by separate resolution. PROJECT DESIGN FEATURES The Del Rio Development Plan includes several project design features that have been incorporated into tbe proposed project to lessen potential impacts, which are listed below:PDF- l The sports park is located within the southwest portion of the Del Rio project site away from Glassell St. and setback from Lincoln Ave. so that: Proposed residential neighborhoods within the project site, border the park on only the east and northeast side, thus minimizing the Sports Park/residential interface. Existing adjacent residential areas along and across Glassell St. and across Lincoln Ave. are minimally affected. Intrusion of night lighting (planned to be oriented inward to the park) and noise will be minimized for thcse same existing residential neighborhoods around the Del Rio project site. Projects subject 10 this requirement shall prepare and implement a Stormwater Pollution Prevention Plan SWPPP). A copy of the current SWPPP shall be kept at the project site and be available for City and County review on request.Prior to approval of grading plans for residential construction and suppol1ing infrastructure, the applicant shall submit, in a manner meeting City and County approval, an Erosion and Sediment Control Plan (ESCP) to demonstrate compliance with local and state water quality regulations during construction activities for residential uses and sUPPol1ing infrastructure. The treatment wetlands and bio-swale will be natural-appearing depressions in the land, designed integral pal1s of the open space. Inclusion of the treatment wetlands and bio-swale in the proposed Del Rio Development Plan will ensure that Santa Ana RWQCB stormwater runoff and water quality treatment requirements are met.The first stage of the treatment system will be a vegetation screen along the bio-swales and treatment wetlands for trash and litter.The second stage of the treatmenl system will be a linear swale system ( bio-swale)planted with specific material and imbedded with highly penneable sand and gravel wrapped in fabric to promote infiltration. The long length of this bio-swale will create a lengthy travel path for urban runoff to infiltrate into the substrate for ful1her microbial breakdown.The area above the swale will be planted with landscape material specifically chosen to minimize the erosion potential from runoff while providing vegetative uptake functions. The bio-swale will drain into a treatment wetland sized to contain the "first flush" of storm waler runoff from the project and acting as a polishing stage for ful1her breakdowu of bacteria, nutrients. and other conslituent pollulants.A foot-trail, observation points, and open fencing will be used for all of the water quality treatment elements to promote the public' s awareness of the urban runoff issue whileofferingenjoymentOPPOl1unitieswithin City of Orangtl Del Rio ~velopment Plan. Findings of Fact HYDROLOGY AND WATER QUALITY SiGnificant Impact The proposed project drains into Reach 2 of the Santa Ana River. (Reach 2 is not currently listed on the Clean Water ACl 303(d) list of impaired water bodies, nor is it one of the proposed listing for the new 2002 303(d) list.) Finding Changes or alterations have been required in, or incorporated into, the project, which mitigate to a level of insignificance or avoid the significant effecls on the environment. Facts In Support of the Finding The significant effect has been eliminated or lessened to a level that is less than significant by the mitigation effected by PDF-A through PDF-E and PDF-8 through PDF- 13, and the following mitigation measures which are identified in the Final Project EIR and incorporated into the project: MitiQation Measures HWQ-l HWQ-2 HWQ-3 Non-structural BMPs will be employed through a cooperative effort between the City of Orange and the Homeowners Association (HOA) to act as an upstream treatment stage for entrapment of hydrocarbons, street grit, and other automobile-related contaminants. Under this altemative, the project site would remain within unincorporated Orange County and not annexed to the City of Orange.I. The No projecllExisting Use Altemative would reduce some of the project specific impacts, and thus is environmentally superior to the Proposed Project, but would not address the objectives of the proposed project as described in Section 3.4of the Final Project EIR.2. The No ProjecllExisting Use Alternative would be consistent with the goals and policies of the County of Orange General Plan. since this alternative would not result in annexing the project site to the City of Orange. the project would not be subject to the City of Orange General Plan under this altemative.3. The Findings of the Proposed Project set forth in this document provide support for the Proposed Project and the elimination of this alternativ" from further consideration. COUNTY OF ORANGE HOUSING PROGRAM ALTERNATIVE The County of Orange Housing Program Alternative considers the use of a portion of the project site for affordable housing. Table 6-2 .2-1 identifies the development intensities as proposed under the Del Rio Development Plan and correspondingly, the development intensity that would need to occur on the project site to meet the affordable housing objectives of the County Housing Element.The County of Orange Housing Program Alternative reflects the highest possible densities allowed within the parameters of the medium residential designation, proposed for Planning Areas I, 2 and 3,and the parameters of the high residential designation, proposed for Planning Area 4. This Alternative, therefore, does not reflect the affordable housing development objective (20 du/acre) for Planning Areas I through 3. However. since Planning Area 4 is proposed to be developed at a greater density than the 20 du/acre objective, it is assumed that this will assist in offsetting the lower densities in Planning Areas I through 3.Michl"" Brandman Associates City of Orange Del Rio Development Plan - Findings of FacI I. Development within Planning Area 4 would occur within the parameters of the LMDR (Low- Medium Density Residential, maximum 15 dwelling units per acre. Overall site residential development at these lower densities would he reduced to 486 dwelling units, as reflected in the following table compared to the 716 dwelling units proposed under the Del Rio Development Plan).. There would be no change in the site acreage for each planning area since the development areas are constrained by the significant park and open space component I. The Lower Density Residential Alternative may reduce some of the project specific impacts, and thus is environmentally superior to the Proposed Project, but would not fully achieve the objectives of the proposed project as identified in Section3.4 of the Final Project EIR.2. The Lower Density Residential would require an amendment to the County of Orange General Plan and/or the City of Orange General Plan, to allow for the residential land uses.3.
