RES-9823 General Plan Amendment 3091 W Chapman Ave.RESOLUTION NO. 9823 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING A GENERAL PLAN AMENDMENT TO REDESIGNATE PROPERTY LOCATED AT 3001 WEST CHAPMAN AVENUE FROM GENERAL COMMERCIAL TO AJLLOW HIGH DENSITY RESIDENTIAL, REDESIGNATE PROPERTY LOCATED AT 3091 WEST CHAPMAN AVENUE FROM GENERAL COMMERCIAL TO ESTABLISH A NEW OVERLAY DISTRICT H TO ALLOW AN INCREASE IN F.A.R. AND HIGH DENSITY RESIDENTIAL, AND REDESIGNATE PROPERTY LOCATED IN THE SERRANO HEIGHTS SPECIFIC PLAN ON THE SOUTH SIDE OF SERRANO AVENUE AT ITS INTERSECTION WITH KENDRA DRIVE TO ADJUST THE BOUNDARY OF THE SPECIFIC PLAN, DESIGNATE A PORTION OF THE AREA FOR A PVBLIC PARK SITE AND ENLARGE AN AREA DESIGNATED FOR MEDIUM DENSITY RESIDENTIAL. APPLICANTS: BRE PROPERTIES TRAMMELL CROW RESIDENTIAL SUN CAL COMPANIES AND ORANGE UNIFIED SCHOOL DISTRICT WHEREAS, the City Council has the authority per Government Code Section 65350 et seq., to amend the City's General Plan when it finds it to be in the public interest; and WHEREAS, BRE Properties (BRE) , Trammell Crow Residential (Trammell Crow) and Sun Cal Companies along with the Orange Unified School District (Sun Cal) have filed applications with the City requesting amendment to the land use element ofthe General Plan to re-designate various properties to accommodate their respective projects; and WHEREAS, the City Council has the authority per Government Code Section 65358(b), to group unrelated general plan amendments into one action; and WHEREAS, the Planning Commission has reviewed each of the requested General Plan Amendments in accordance with Government Code Section 65353; and WHEREAS, the City Council held duly advertised public hearings on January 13, 2004 and January 27,2004 for the purpose of considering, among other things, the amendment to the land use element of the General Plan upon the properties described in Exhibit A; and WHEREAS, in compliance with the California Environmental Quality Act ( CEQA)and State CEQA Guidelines the City has pn:pared either an Environmental Impact Report hereinafter EIR) or Mitigated Negative Declaration (hc:reinafter MND) to evaluate the potential adverse environmental effects of the projects :md related amendments to the land use element of General Plan; and WHEREAS, in each instance the City Council certified and adopted the appropriate environmental document in accordance with CEQA at a legally notice public hearing. NO'\', THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF ORANGE THAT THE LAND USE ELEMENT OF THE GENERAL PLAN IS HEREBY AMENDED BASED ON THE FOLLOWING FINDINGS: 1. That the proposed action furthers the City's General Plan goals of providing additional recreational facilities and housing opportunities. 2. That the California Government Code :md City of Orange requirements for a General Plan Amendment have been appropriately and adequately addressed. 3. That the subject sites are physically suitable for the type and intensity of the land uses being proposed. 4. That there is adequate public access and adequate utilities to servIce the proposed public park and residential developments. 5. That the project locations, size and design are compatible with existing surrounding development and neighborhoods. 6. That the projects provide for safe and adequate vehicular and pedestrian circulation, both on and off- site.7. That the general plan amendment is granted upon sound principles of land use and in response to services required by the community.8. That the general plan amendment will not cause deterioration of bordering land uses or create special problems for the areas in which the sites are located.9. That the general plan amendment has been considered in relationship to its effect on the community or neighborhood for the areas in which the sites are located.10. That there is no evidence before the City Council of the City of Orange that the proposed public park site or residential developments will have any potential for adverse affects, either individually or cumulatively, on wildlife resources or the habitat upon which the wildlife depends.11. That the data and analysis upon which these findings of fact are based are set forth in the staff reports, oral presentation, public testimony, and Commissioner comments, that constitute the record which is the basis for the City Council's review and approval of this general plan amendment. 12.
