A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE APPROVING PROPERTY TAX
EXCHANGE AGREEMENT BETWEEN THE CITY
OF ORANGE AND THE COUNTY OF ORANGE FOR
THE ANNEXATION OF THE UNINCORPORATED
TERRITORIES OF EAST ORANGE AND
SANTIAGO HILLS II.
WHEREAS, the City of Orange (hereafter City) is contemplating the annexation of
certain unincorporated territories within City's sphere of influence which are known and are
hereinafter referred to as East Orange and Santiago Hills 1I; and
VvHEREAS, Revenue and Taxation Code Section 99 provides that prior to the
effective date of any jurisdictional change, the affected agencies of such change shall
negotiate the amount of property tax revenues to be exchanged; and
VvHEREAS, representatives of City and the County of Orange (hereafter County)
have met and negotiated both a property tax exchange and other consideration, all of which is
conditioned upon City's annexation of the East Orange <md Santiago Hills II territories, and
such annexation becoming final and effective.
NOW, THEREFORE, BE IT RESOIJVED by the City Council of the City of
Orange as follows:
The City Council of the City of Orange hereby approves the Property Tax Exchange
Agreement between City and County which is attached hereto and incorporated herein by this
reference. In accordance with the provisions of that Agreement, upon completion of the
annexation of the East Orange and Santiago Hills 1I territories, the City and County will
divide County's share of the basic 1 % property tax levy generated within the annexed area,
with City to receive 69% and County to retain the remaining 31 %. Upon completion of the
annexation, City will also receive 100% of the Structural Fire Fund and the County Library
Fund that is generated within the unincorporated areas.
