RES-9807 Application for Grant Funds of Urban Park Act Coastal Protection ActRESOLUTION NO. 9807 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AUTHORIZING SUBMISSION OF AN APPLICATION FOR GRANT FUNDS FOR THE URBAN PARK ACT OF 2001 PROGRAM UIYDER THE CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS, AND C'OASTAL PROT'ECTION ACT OF 2002. Application for the Construction of a Gymnasium/Sports Center WHEREAS, the people of the State of California have enacted the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002 the Act), which provides funds to the State o' California for grants to eligible Applicants; and WHEREAS, the California Department of Parks and Recreation has been delegated the responsibility for the administration of the Urban Park Act of 2001 Pro€;ram and the grant Project shown above within the State, setting up necessary procedures; and WHEREAS, said procedures established by the California Deparhnent of Parks and Recreation require the Applicant's Govern.ing Body to certify by resolution the approval of the Application before submission of'said Application to the State; and WHEREAS, the Applicant will enter inta a Contract with the State of California for t:he Project; and WHEREAS, an Initial Study and Mitigated Negative Declaration (Subsequent Mitigated Negative Declaration No. ENV 1601-99, dated November 2000j has already been prepared in accordance with the provisions of CEQA to analyze the environmental impacts of the proj ect. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: 1. The foregoing recitals are true and correct:; and 2. The City Council hereby approves the filing of an Application for local assistance funds from the Urban I'ar:k Act of 2001 Program under the California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act of 2002:; and 3. The City Council certifies that the Applicant has or will have sufficient funds to operate and maintain the Project; and 4. The City Council certifies that the Applicant has reviewed, understands, and agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and 5. The City Council certifies that the Grante;e rias or will have available, prior to commencement of any work: on the Project, the proportional Match; and 6. The City Council certifies that the Projec;t conforms to the recreation element of any applicable city or county eneral plan; and 7. The City Council hereby appoints the City Manager or his designee as agent to conduct all negotiations, f;xecute and submit all documents including, but not lirnited ta, pplications, agreements, payment requests and so on, whxch may be necessary for the completion of the Project.
