RES-10017 Vacating Portion of Manchester AvenueRESOLUTION NO. 10017 I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE STATING ITS INTENT TO VACATE A PORTION OF THAT PUBLIC STREET COMMONLY KNOWN AS MANCHESTER AVENUE GENERALLY LOCATED ON THE WESTERLY SIDE OF MANCHESTER AVENUE AND NORTH OF COMPTON AVENUE WHEREAS, upon the request of the City of Orange Redevelopment Agency, the City Council of the City of Orange declares its intent to vacate that portion of Manchester Avenue generally depicted on the maps attached hereto as Exhibit B and Exhibit C and more particularly described on Exhibit A, which is a public street and right-of-way located on the westerly side of Manchester Avenue, north of Compton Avenue; and WHEREAS, the City Council intends to reserve and except from such vacation: (1) all existing easements for public utility facilities line purposes and any right necessary to maintain, operate, replace, remove or renew such public utilities or other public improvements underlying the subject easement; and (2) the easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove, and renew sanitary sewers and storm drains and appurtenant structures in, upon, over, and across that portion of Manchester Avenue proposed to be vacated and, pursuant to any existing franchise or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew, and enlarge lines of pipe, conduits, cables, wires, poles, and other convenient structures, equipment, and fixtures for the operation of gas pipelines, telegraphic and telephone lines, railroad lines, and for the transportation or distribution of electric energy, petroleum and its products, ammonia, and water, and for incidental purposes, including access to protect these works from all hazards in, upon, and over that portion of Manchester Avenue proposed to be vacated; and I WHEREAS, the vacation of that portion of Manchester Avenue for public road and highway purposes is conducted pursuant to Division 9, Part 3, Chapter 3 of the Streets and Highways Code (commencing at Section 8320); and WHEREAS, a hearing for all persons interested in the proposed vacation shall be held on October 25, 2005 at 4:30 p.m. in the Council Chambers of the City of Orange, 300 E. Chapman Avenue, Orange, California, or as soon thereafter as the matter may be heard. NOW, THEREFORE the City Clerk is hereby directed to publish and post this resolution of intention in the manner required by Sections 8322 and 8323 of the Streets and Highways Code of the State of California.
