RES-9997 Letter of Understanding Orange City Fire FightersRESOLUTION NO. 9997 I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ESTABLISHING A LETTER OF UNDERSTANDING BETWEEN THE CITY OF ORANGE AND THE ORANGE CITY FIRE FIGHTERS, LOCAL 2384, INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS, AFL-CIO EFFECTIVE JULY 1, 2005 THROUGH FEBRUARY 29,2008 WHEREAS, the City of Orange, hereinafter referred to as City, and the Orange City Fire Fighters, Local 2384, International Association of Fire Fighters, AFL-CIO, hereinafter referred to as Union have met and conferred in accordance with the requirements of the Meyers-Milias-Brown Act; and WHEREAS, the City and the Union have reached agreement on wages, salaries, and other terms and conditions of employment effective July 1, 2005 through February 29,2008; and WHEREAS, the City and the Union agree to incorporate the provisions contained in the attached Letter of Understanding into a new Memorandum of Understanding at some future date once both parties have an opportunity to review and concur on any and all language changes to be included in a new Memorandum of Understanding; and WHEREAS, the City Council has consulted with the City Manager and Personnel Director concerning the proposed employment terms contained in the attached Letter of Understanding; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that the attached Letter of Understanding is approved and incorporated by reference as Exhibit A. These discussions resulted in this LOU between the City and the Union, who have agreed to the following: Term of Agreement July I, 2005 through February 29,2008 Salary Increases 5.0% Across-the-board raise effective 6/26/2005 5.0% Across-the-board raise effective 2/19/2006 Increase base salaries to survey market median by classification for all classes minimum of 3.0% and maximum of 6.0%) effective 2/18/2007 I The Union and the City will conduct a salary survey by or before February 28, 2007 of all Fire Departments throughout the County to determine the maximum (top step) base salary for each classification covered by this MOU. The median calculation will exclude Orange Fire Department salaries. The contractual March 2007 salary data trom the survey agencies will be utilized for any necessary adjustments. In the event any classification is below the median of the surveyed agencies, the City shall increase the entire salary range of that classification in 0.5% increments at a minimum of 3.0% to a maximum of 6.0% to bring the salary level to the survey median. However, if any of the classifications are at or above the median, employees covered by this agreement within those classifications shall receive a 3.0% salary increase. The effective date for any applicable salary increases will be February 18, 2007 3 PERS Cost-Sharing Safety employees continue to participate in PERS Retirement Cost-Sharing; City agrees to cap contribution rate at 3.1 % for duration of contract. Non-safety employees will continue to participate in PERS Retirement Cost-Sharing; City agrees to cap contribution rate at 2.64% for duration of contract. City shall reimburse the additional 2.02% paid by non-safety employees since July 1, 2005. Union Group Benefit Plan Effective July 1, 2005, the City will no longer contribute $113.80 per month toward the Union Group Benefit Plan. In exchange, the City will provide the medical insurance contribution amounts as noted above to provide for medical, dental, and vision insurance coverage, and/or taken as cash if applicable. Effective July 1, 2005, the City will provide $36.00 per month per employee toward the Union Group Benefit Plan for the Union to provide life insurance and long term disability insurance to their membership. Employees will continue purchasing dental and vision insurances through the Union's Group Benefit Plan for the remainder of the 2005 calendar year. During the City's 2005 Open Enrollment period (September 15 through October 15, 2005) employees will be allowed to enroll in the City's dental and vision insurance plans. " Bereavement Leave Effective July 1, 2005, provide bereavement leave equal to provIsIOn for other City employees. Bereavement leave will not be charged to employee sick leave. Bereavement leave is to be provided as 2 Shifts per incident for Suppression Personnel, and 3 Days per incident for 40-hour personnel. In the event an employee shall need more time, additional time can be taken from the employee's sick leave account. This requires approval by the Department. Language changes to include other relatives including grandparent, substitute parent, and parent-in-law. Management Issues Fire Union has agreed to each ofthe following: Acknowledge the Employee Handbook as an official City document Implement FLSA language changes to reflect current pay practices, as discussed during negotiations Establish a limit on Union Time Off to 264 hours per fiscal year effective July I, 2005, exclusive of time spent for collective bargaining and grievance processing Implement OPERATIONS STAFFING POLICY, G.O. #200.02, dated August I, 2005, as agreed by both parties Implement OPERATIONAL ASSIGNMENT BID POLICY, G.O. #200.10, dated July 18, 2005, as agreed by both parties New Memorandum of Understanding I The City and the Union agree to incorporate the provisions contained in this Letter of Understanding into a new Memorandum of Understanding once both parties have had an opportunity to review and concur on any and all language changes included in the new MOU. 5 Ratification and Execution The City and the Union acknowledge that this Letter of Understanding shall not be in full force and effect until ratified by the Union and adopted by the City Council of the City of Orange.
