RES-9952 Requesting to Allocate Combined Transportation Program Funds for Critical Street Improvement ProjectsRESOLUTION NO. 9952 I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE REQUESTING THE ORANGE COUNTY TRANSPORTATION AUTHORITY TO ALLOCATE COMBINED TRANSPORTATION PROGRAM FUNDS FOR ACQUISITION OF RlGHT- OF-WAY FOR THE CHAPMAN AVENUE/PROSPECT STREET CRITICAL INTERSECTION WIDENING, PROJECT NO. 00- ORNG-IIP-3141.WHEREAS, the City of Orange (the City) is a municipal corporation which exercises governmental functions and powers, and is organized and existing under the laws of the State of California; and WHEREAS, the City Council has heretofore authorized certain street widening improvements to be made to the intersection of Chapman Avenue and Prospect Street and (the Intersection Improvement Project); and WHEREAS, the Orange County Transportation Authority ( OCTA) approved a Combined Transportation Funding Program (CTFP) for Fiscal Year 2000-01; and WHEREAS, included in the CTFP for Fiscal Year 2003-04 was the sum of$1,012,056 for the acquisition of right-of- way for the Intersection Improvement Project; and WHEREAS, the City of Orange has adopted a General Plan Circulation Element which does not preclude implementation of the Intersection Improvement Project within its jurisdiction; and WHEREAS, the City of Orange has (1) prepared all right-of-way documents, (2)designed the Intersection Improvement Project, and (3) completed required preparatory work in accordance with the standards required by the City and other affected jurisdictions involved with the Intersection Improvement Project; and I WHEREAS, this City Council desires to request OCTA to allocate to the City the sum of $1,012,056 of CTFP funds for the City's use for right-of-way acquisition for the Intersection Improvement Project.NOW THEREFORE, be it resolved by the City Council of the City of Orange, on the basis of the facts set forth in the agenda report presented to it and any testimony received at the meeting at which this matter was considered, as Section 2. That the City of Orange hereby requests the OCTA to allocate to the City the sum of$1,012,056 ofCTFP funds from the Intersection Improvement Program for right- of-way acquisition for the City's Intersection Improvement Project. This request is in conformance with the CTFP allocation process and does not exceed ninety percent (90%) ofthe programmed amount or ninety percent (90%) of the right-of-way expenditures incurred as of March 31, 2005,Section 3. That the City of Orange agrees to fund its share of the right-of-way costs for the Intersection Improvement Project and any additional costs over the sum of$1,012,056.Section 4. The City of Orange agrees to submit a Final Report to the OCTA within one hundred twenty (120) days after the City's finalization of its right-of-way acquisition, at which time the OCTA will transfer to the City the remaining ten percent (10%) of the programmed funds for approved expenditures as determined by OCTA from the items of work eligible for reimbursement under the CTFP guidelines, ADOPTED this lih day of April, 2005, c- fM Murphy, May' r City of Orange ATTEST:MaryE,6 I, MARY E.
