RES-10100 Vacating Portion of Easement Saxon StreetRESOLUTION NO. 10100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE VACATING A PORTION OF AN EASEMENT FOR PUBLIC ROAD AND HIGHWAY PURPOSES ON REAL PROPERTY GENERALLY LOCATED AT THE SOUTHERLY END OF SAXON COURT (A STREET) AS SHOWN ON PARCEL MAP NO. 2004-302 IN THE CITY OF ORANGE.WHEREAS, the City Council did accept an offer of dedication for Saxon Street ( A Street) as offered on Parcel Map Number 2004-302 on January 25, 2005 pursuant to Provisions of Section 66436 (a)(3)(A) of the Subdivision Map Act and said map was recorded on May 18, 2005 in Book 343, Pages 22 through 28 of Maps in the Office of the Orange County Recorder; and WHEREAS, the date of dedication is less than is less than five years, and more than one year and the easement has not been used continuously since that date.NOW THEREFORE, the City Council declares, on the basis of the facts set forth in the agenda report presented to it and any testimony received at the meeting at which this matter was considered, as follows:Section 1.The foregoing recitals are true and correct.Section 2. Pursuant to Division 9, Part 3, Chapter 3 of the Streets and Highways Code, Section 8330 et seq., that portion of an easement for public road and highway purposes on real property generally located at the southerly end of Saxon Court (A Street) as shown on Parcel Map No. 2004-302, which is specifically shown on the legal description, attached hereto as Exhibit A and maps, attached hereto as Exhibits B, is hereby summarily vacated effective upon recordation of this Resolution in the Official Records of the County of Orange,State of California ( the Official Records).Section 3. The date of dedication is less than five years and more than one year and the easement has not been used continuously since the date of acquisition.Section 4. The easement for public road and highway purposes described in this Resolution is unnecessary for present or prospective public use for the reasons described in the agenda report accompanying this Resolution.Section 5. The City Clerk is hereby authorized and directed to cause a certified copy of this Resolution, attested by the City Clerk under seal, to be recorded without acknowledgement in Section 6. From and after the date a certified copy of this Resolution is recorded in the Official Records, the easement for public road and highway purposes shall no longer constitute a public street.
