RESOLUTION NO. 10071
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE STATING ITS INTENT TO
VACATE A STREET EASEMENT OVER A
PORTION OF RIVERDALE AVENUE, WEST OF
GLASSELL STREET, SETTING A PUBLIC
HEARING THEREON, AND DIRECTING NOTICE
THEREOF TO BE POSTED AND PUBLISHED.
WHEREAS, the subject street easement as depicted on the map and legal description
attached hereto as Exhibit A, was dedicated to the City in 1971 to ultimately be used as an
east-west connector road between Batavia Street and Glassell Street;
and WHEREAS, as a result of the approval of the Del Rio housing development,
this east-west connector road was deleted from the City's Master Plan of Arterial
Highway and thus, the street easement is not needed for either existing or prospective
public street
purposes; and WHEREAS, the City Council intends to reserve and except from such
vacation all existing easements for public utility facilities line purposes and any right
necessary to maintain, operate, replace, remove or renew such public utilities or
other public improvements underlying the subject
easement; and WHEREAS, the vacation of the subject street easement is conducted pursuant
to the Public Streets, Highways, and Service Easements Vacation Law (Division 9, Part
3, Chapter 3 of the Streets and Highways Code, commencing at Section
8300); and WHEREAS, a hearing for all persons interested in the proposed vacation
shall be held on May 23, 2006 at 4:30 p.m. in the Council Chambers of the City of Orange,
300 E.Chapman A venue, Orange, California, or as soon thereafter as the matter may
be heard.NOW, THEREFORE the City Clerk is hereby directed to publish and
post this resolution of intention in the manner required by Sections 8322 and 8323 of the
Streets and Highways Code of the State
of California.ADOPTED this 25th day of
April, 2006.
