A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE AMENDING THE MASTER
SCHEDULE OF FEES AND CHARGES AS
AUTHORIZED BY ORANGE MUNICIPAL CODE
CHAPTER 3.10 BY ADDING FEES AND CHARGES
FOR THE USE OF FRED KELLY STADIUM.
WHEREAS, pursuant to Chapter 3.10 of the Orange Municipal Code, the City Council
has established and maintained a Master Schedule of Fees and Charges, consisting of fees and
charges for the use of City facilities and services provided by the City to persons using such
facilities and services; and
WHEREAS, in accordance with the mandate of Chapter 3.10 of the Orange Municipal
Code, the Master Schedule of Fees and Charges has been periodically amended and revised
from time to time by the City Council; and
WHEREAS, the Stadium consists of recreational facilities, including a running track
the Track) and a sports field (the Field), and support facilities, including parking lots,
restrooms, sitting stands and concession stands (collectively herein, the Support Facilities and
together with the Stadium, Track, and Field, the Recreational Facilities).
WHEREAS, the City Council hereby finds and determines that the Master Schedule of
Fees and Charges should be amended in part to provide for certain fees and charges relatmg to
the use of the recreational facilities, including a running track, a sports field, and support
facilities (including parking lots, restrooms, sitting stands and concession stands_recreational
facilities, including a running track (the Track) and a sports field (the Field), and support
facilities, including parking lots, restrooms, sitting stands and concession stands) at Fred Kelly
Stadium located at 3120 E. Spring Street in the City of Orange (herein referred to as the
Stadium Facilities), which fees and charges represent not more than the true cost of providing
the use of the Stadium Facilities in connection with such fees and charges.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Orange
as follows:

1. The Master Schedule of Fees and Charges is hereby amended and Attachment
A to this Resolution entitled, Additions to the Current Master Schedule of Fees and Charges, is
hereby adopted, amending, supplementing and modifying the Master Schedule of Fees and
Charges to provide for the inclusion of the amount of fees and charges for the use of the
Stadium Facilities, as more particularly described on said Attachment A.
2. The City Council finds that the fees and charges set forth in Attachment A do
not exceed the reasonable costs for the use of the Stadium Facilities and the services provided
by the City in connection with the use thereof.
3. The fees and charges listed in Attachment A shall be effective as of the date of
this Resolution.
4. If any fee, charge, or rate set forth in this Resolution or the application thereof to
any person or circumstance is held to be unconstitutional or otherwise invalid by any court of
competent jurisdiction, such invalidity shall not affect any other fee, charge, or rate, or
application thereof, which can be implemented without the invalid fee, charge, or rate, or
application thereof, and to this end the fees, charges and rates of this Resolution are declared to
be severable.
