RES-10195 Repealing Resolution 9295 Revising Fire Protection Facilities Fee AreasRESOLUTION NO. 10195 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE REPEALING RESOLUTION NO. 9295 AND REVISING THE FIRE PROTECTION FACILITIES FEE AREAS AND RELATED FEES WHEREAS, the City Council adopted Chapter 15.38 of the Orange Municipal Code to require that developers contribute their fair share of the costs of the acquisition and construction of new fire protection facilities and certain other improvements and additions to fire protection facilities; and WHEREAS, Chapter 15.38 of the Orange Municipal Code was amended by the City Council on March 13, 200 I to allow for the boundaries of the fire protection facilities program areas, which are referred to in this Chapter, to be revised, deleted or otherwise amended by Resolution of the City Council. WHEREAS, Orange Municipal Code provides that fees may be increased by resolution adopted by the City Council; and WHEREAS, the City Council has determined the fees should be adjusted to more equitably allocate new development's fair share of the cost of new fire facilities and to cover the increased construction costs; and WHEREAS, the City contracted with a consultant to perform an analysis of the fees necessary to be charged to new development to provide the fire protection facilities required as a result of such development; and WHEREAS, the consultant performed this analysis and calculated the fees in compliance with the requirements of the Mitigation Fee Act (California Government Code Section 66000 et seq); and WHEREAS, the City Council has considered the information in the consultant's report and the City's staff report; and NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Orange that the six current Fire Protection Facilities Program areas (A, B, C, D, E, and 0) be consolidated into one city-wide fire protection facilities program area with only one fee; and BE IT FURTHER RESOLVED that the fees for the one city-wide Fire Protection Facilities Program area are hereby adopted as set forth in Exhibit A and Resolution No. 9295 is rescinded.BE IT FURTHER RESOLVED that the Fire Protection Facilities Program fees shall be adjusted on the first day of July each year, beginning July 2008, to reflect the percentage of construction cost increase or decrease as published by the Engineering News Cost Index published on, or about, the first day of June each year. The adjusted fee, if any, shall be rounded to the nearest dollar for the per unit and per room fees and to the nearest one tenth of a cent for the per sq. ft. fees.
