A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE ACCEPTING AN
IRREVOCABLE OFFER OF DEDICATION FROM
NORTH ORANGE DEL RIO LAND, LLC, FOR
LAND UNDERLYING THE FUTURE STEVEN F.
AMBRIZ MEMORIAL PARK AND AUTHORIZING
THE CITY CLERK TO RECORD SAME.
WHEREAS, the City of Orange (the City) is a municipal corporation which exercises
governmental functions and powers and is organized and existing under the laws of the State of
California; and
WHEREAS, Section 37350 of the Government Code of the State of California
authorizes the City to receive, hold, and enjoy real property for any authorized City purpose;
and
WHEREAS, the City and Del Rio LLC entered into a Development Agreement (DA)
that governs the rules, regulations, exactions and other conditions of the "Development", as
that term is defined in the DA; and
WHEREAS, pursuant to the DA, at appropriate points in the Development Del Rio is
required, among other things, to irrevocably offer for dedication the parkland and do so prior to
the issuance of any certificates of occupancy for the Development; and
WHEREAS, the parkland being offered for dedication will be improved by Del Rio
LLC or a successor in interest as the site of the future Steven F. Ambriz Memorial Park, a
public park; and
WHEREAS, the Development has progressed to a point where residential units are
ready to be sold and certificates of occupancy issued; and
WHEREAS, based on the above the City Council has determined, in its reasonable
discretion, that this is an appropriate time in the Development to accept the irrevocable offer of
dedication.
NOW, THEREFORE, the City Council of the City of Orange resolves that the
irrevocable offer of dedication from North Orange Del Rio Land, LLC, a limited liability
company (Exhibit A), is hereby accepted and the City Clerk is authorized to execute the
Acknowledgement and Acceptance of City and upon doing so record same with the County of
Orange.
ADOPTED this 9th day of January, 2007.
