A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE AUTHORIZING THE
SUBMITTAL OF AN APPLICATION TO THE
CALIFORNIA DEPARTMENT OF
TRANSPORTATION'S BICYCLE FACILITIES UNIT
FOR A GRANT UNDER THE 2008-09
BICYCLE TRANSPORTATION ACCOUNT FOR THE
DESIGN AND CONSTRUCTION OF A CLASS I
BIKEWAY ALONG THE NORTHERLY SIDE OF
BOND AVENUE BETWEEN PROSPECT STREET
AND HEWES STREET AS PART OF THE
SANTIAGO CREEK BIKE
TRAIL.WHEREAS, the California Department of Transportation's (Caltrans)
Bicycle Facilities Unit administers the Bicycle Transportation Account program (the
Program),which provides State funds for city and county projects that improve the safety
and convenience for bicycle commuters;
and WHEREAS, the City of Orange desires to provide bicycle facilities that offer
safety and convenience to its bicycle commuters;
and WHEREAS, the City Council of the City of Orange wishes to submit an
application to the Bicycle Facilities Unit for funds under the Program to design and construct a Class
I bikeway along the northerly side of Bond Avenue between Prospect Street and Hewes
Street the Project) as part of the City's Santiago Creek Bike Trail;
and WHEREAS, this City Council, as the lead agency under the California
Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as CEQA),
finds and determines that the Project is categorically exempt from the provisions of CEQA
pursuant to a Class 1 categorical exemption as set forth in Section 15301 of Title 14 of the
California Code of Regulations (herein referred to as the State CEQA Guidelines) because the
Project consists of the minor alteration of existing public streets involving negligible or no
expansion of use;
and WHEREAS, the City's proposed Project will be matched by funds from the City
in the amount of $91,600 toward the total Project cost of $916,000. The City's funds will
come from the County of Orange's allocation of bond funds for road capital and
maintenance projects passed by California voters in 2006 and commonly known as Proposition
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Orange as follows:
1. The foregoing recitals are true and correct.
2. Because the Project is categorically exempt from the provisions of CEQA under
Section 15301 of the State CEQA Guidelines, the City Clerk is hereby authorized and directed
to file a Notice of Exemption with the Orange County Clerk.
3. The City's Director of Public Works is hereby authorized, as agent of the
City, to prepare, execute and submit a Bicycle Transportation Account grant application to
the Caltrans' Bicycle Facilities Unit for funds under the Program in the amount of $824,400
and to conduct all negotiations, execute and submit all documents including, but not limited
to, agreements, payment requests and such other documentation as the Director of Public
Works deems necessary and appropriate, after review by the City's Director of Finance and
City Attorney, to consummate the transaction contemplated by the adoption of this
Resolution and to administer the City's obligations, responsibilities and duties to be
performed hereunder and under any agreement entered into with the State of California or
any of its authorized departments or agencies in connection with the Program.
4. This City Council hereby certifies that the City of Orange has or will have
sufficient funds in an amount not less than $91,600 to commit toward the total Project cost of
916,000.
