RES-10330 Readopting City's Bikeways Master PlanRESOLUTION NO. 10330 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE READOPTING THE CITY'S BIKEWAYS MASTER PLAN. WHEREAS, by the adoption of Resolution No. 9418 on February 27,2001, the City Council of the City of Orange amended the Circulation Element of the City's General Plan to update the Bikeways Master Plan; and WHEREAS, prior to the adoption of said Resolution No. 9418 and as the lead agency under the California Environmental Quality Act (CEQA), the City Council of the City of Orange determined that the amendment of the Circulation Element of the City's General Plan to update the Bikeways Master Plan would not have a significant effect upon the environment and, accordingly, adopted a Negative Declaration therefor; and WHEREAS, the California Department of Transportation ("Caltrans") Bicycle Transportation Account grant program (the Program), provides state funding for the construction of bicycle lanes and routes for local agencies that meet specific eligibility requirements, including having a Bicycle Master Plan that has been adopted between January 1, 2004 and December 31, 2008; and WHEREAS, Caltrans' Bicycle Facilities Unit administers the Program; and WHEREAS, this City Council wishes to submit an application to the Bicycle Facilities Unit for funds under the Program to design and construct a Class I bikeway along the northerly side of Bond Avenue between Prospect Street and Hewes Street (the Project) as part of the City's Santiago Creek Bike Trail; and WHEREAS, in order to meet the eligibility requirements under the Program, this City Council desires to re-adopt, without modification or amendment, the City's Bikeways Master Plan; and WHEREAS, this City Council finds and determines, as the lead agency under CEQA,that the re-adoption of the City's Bikeways Master Plan is exempt from the provisions ofCEQA under Section 15061(b)(3) of the State CEQA Guidelines because it can be seen with certainty that there is no possibility that the re-adoption of the Bikeways Master Plan may have a significant effect NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: 1. The foregoing recitals are true and correct. 2. The City's Bikeways Master Plan, in the form presented at the meeting at which this Resolution was considered and adopted, is hereby re-adopted, without modification or amendment, which Bikeways Master Plan shall remain a part of the Circulation Element of the General Plan.ADOPTED this 28th day of October, 2008 ATTEST:I, MARY E.
