RES-10318 Mitigated Negative Declaration Dedication of Trails 7845 E. Santiago Canyon Rd.RESOLUTION NO. 10318 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING AND ADOPTING MITIGATED NEGATIVE DECLARATION NO. 1768- 06 AND GENERAL PLAN AMENDMENT NO. 2006- 0001 AMENDING THE OPEN SPACE ELEMENT TO REFLECT THE DEDICATION OF TRAILS TO BE INCLUDED IN THE MASTER PLAN OF RECREATIONAL TRAILS ON PROPERTY LOCATED AT 7845 EAST SANTIAGO CANYON ROAD. APPLICANT: ROMAN CATHOLIC DIOCESE OF ORANGE WHEREAS, General Plan Amendment No. 2006-0001 was filed by the City of Orange in accordance with the provisions of the City of Orange Municipal Code; and WHEREAS, General Plan Amendment No. 2006-0001 was processed in the time and manner prescribed by state and local law; and WHEREAS, the proposed General Plan Amendment will amend the Open Space Element of the General Plan to reflect the dedication of trails to be included in the Master Plan of Recreational Trails, linking the project site with the system of trails in the Orange Park Acres area; and WHEREAS, the City Council conducted a duly advertised public hearing on August 26, 2008, for the purpose of considering Mitigated Negative Declaration No. 1768-06 and General Plan Amendment No. 2006-0001 upon property located at 7845 East Santiago Canyon Road.NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orange hereby approves and adopts Mitigated Negative Declaration No. 1768-06 and General Plan Amendment No. 2006-0001 to change the Open Space Element of the General Plan to include the addition of trails to Master Plan of Recreational Trails based on the following findings:SECTION 1 - FINDINGS 1. The project supports the goals and objectives of the General Plan Open Space Element's Master Plan of Recreational Trails by providing a multipurpose, soft surfaced trail for equestrian riders, hikers, and bicyclists. The project links recreational opportunities within the City of Orange and County parks, open spaces,and trail systems. In addition, to further the goals and objectives, the Roman Catholic Diocese of Orange has proposed that the substantial compliance with Exhibit A, attached hereto and incorporated herein, to depict the development standards and construction that promote equestrian safety and flexibility in trail standards to maintain compatibility with adjacent land uses. 2. The expansion of the Holy Sepulcher Cemetery supports the Orange Park Acres Specific Plan (adopted 1973) goals by maintaining an open and informal type of development, uninhibited by regimentation, linking the various area through a system of trails and safe crossings, offering a positive entry treatment and visual distinction to the main elements within the area, and providing for economic viability. 3. The data and analysis upon which these findings of fact are based, including those in Section 2 of this Resolution, are set forth in the staff report for Mitigated Negative Declaration No. 1768-06 and General Plan Amendment No. 2006-0001,staffs oral presentation, public testimony, the Planning Commission record and City Council comments which constitute the City Council's review of this application.SECTION 2 - ENVIRONMENTAL REVIEW 1. Mitigated Negative Declaration No. 1768-06 was prepared for General Plan Amendment No. 2006-0001 in compliance with the California Environmental Quality Act and associated Guidelines.2. The City Council finds that Mitigated Negative Declaration No. 1768-06 contains an adequate assessment of the potential environmental impacts of General Plan Amendment No. 2006-0001. Based on substantial evidence contained in the record,the City Council finds that all potentially significant adverse environmental impacts can be mitigated to a level of insignificance. Therefore, the City Council hereby approves and adopts Mitigated Negative Declaration No. 1768-06.ADOPTED this 26th I, MARY E.
