A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ORANGE APPROVING A SOLID
WASTE FRANCHISE AGREEMENT WI'TH
CR&R INCORPORATED.
WHEREAS, pursuant to the provisions of Public Resources Coc e Section
40059(a)(1), the City of Orange is authorized to determine all aspects of solid waste handling
which are of local concern; and
WHEREAS, Public Resources Code Section 40059(a)(2) also authorizes the City to
determine whether solid waste handling services are to be provided by exclusive or non-
exclusive contract and whether the contract will be awarded with or without competitive
bidding; and
WHEREAS, pursuant to Public Resources Code Section 40059(a)(2), the City may
grant the authority to provide solid waste handling services under terms and conditions
prescribed by it by resolution; and
WHEREAS, the City solicited proposals from qualified solid waste haulers to
provide solid waste services for the City; and
WHEREAS, at its meeting on June 23, 2009, the City Council selected CR&R
Incorporated as the successful proposer; and
WHEREAS, CR&R Incorporated has agreed to provide solid waste services as set
forth in its proposal at the prices set forth therein.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Orange, as follows:
l. The City Council hereby approves the Agreement Between the City of Orange
and CR&R Incorporated for Integrated Solid Waste Management Services, which sets forth
all terms and conditions for the provision of solid waste services, a copy of which was
submitted to the City Council at its meeting on the date set forth below.
2. The Mayor is hereby authorized to execute the Agreement on behalf of the
City.
