RES-ORA-0497 Approval of Periodic Rental of Residential Apartment UnitsRESOLUTION NO. ORA- 0497 A RESOLUTION OF THE ORANGE REDEVELOPMENT AGENCY APPROVING THE PERIODIC RENTAL OF RESIDENTIAL APARTMENT UNITS OWNED BY THE ORANGE REDEVELOPMENT AGENCY AT 124- 142 SOUTH GRAND STREET.WHEREAS, the Orange Redevelopment Agency (Agency) has been duly created,established and authorized to transact business and exercise its powers under and pursuant to the California Community Redevelopment Law (commencing with Section 33000 of the California Health and Safety Code and hereinafter referred to as the Redevelopment Law),including, among other powers, the authority granted to it by Sections 33430 and 33431 of the Redevelopment Law to rent real property or any interest therein; and WHEREAS, the Agency is the owner of that certain real property in the City of Orange, County of Orange, State of California commonly known as 124- 142 South Grand Street and having Assessor's parcel number 390-382-07, which is improved with a two-story building, containing ten (10) residential apartment units (the Property); and WHEREAS, the Property is located within the boundaries of the Orange Merged and Amended Redevelopment Project Area ( the Merged Redevelopment Project Area), which Merged Redevelopment Project Area was duly established by the City Council of the City of Orange on November 27, 2001 by Ordinance No. 21- 01, pursuant to the Redevelopment Law;and WHEREAS, the Board of Directors of the Agency (the Agency Board) desires to rent one or more of the apartment units within the Property to persons 62 years of age or older on a periodic basis until such time as the Agency determines to otherwise dispose of the Property for redevelopment purposes; and WHEREAS, the Agency proposes to rent said apartment units under the authority granted to it by Sections 33430 and 33431 of the Redevelopment Law and Section 51.3 of the California Code of Civil Procedure.NOW, THEREFORE, the Board of Directors of the Orange Redevelopment Agency does hereby resolve as follows:Section 1. The foregoing recitals are true and correct.Section 2. Subject to the parameters and directions set forth in Section 4 below,the Agency's Executive Director (or, in his absence, the Agency's Assistant Executive Director) (each, an Authorized Officer) is hereby authorized and directed to execute and deliver, for and in the name of the Agency, rental approved by the Agency's General Counsel (or, in his absence, the Agency's Assistant General Counsel), with such changes therein as the Authorized Officer executing the same may require or approve upon advice and with the consent of the Agency's General Counsel. Section 3. The Agency's General Counsel (or his designee) is hereby authorized and directed to prepare, or cause to be prepared, the form of rental agreement, together with any and all other documents deemed necessary and appropriate to implement the rental program. Section 4. The authorization set forth in this Resolution regarding the rental of apartment units at the Property is subject to the following parameters: (a) rental of each unit to a person 62 years of age or older (including a qualified permanent resident) in accordance with the requirements of Section 51.3 of the California Civil Code and who otherwise meets all of the requirements provided herein, as determined by the Authorized Officer; (b) rental on a month-to-month basis at the fair rental value (including garbage collection and water) at the time a unit becomes available, as determined by the Authorized Officer; (b)advertisement of the availability of apartment units for rent by posting notice at the Property and at such other locations within the City deemed necessary and appropriate by the Authorized Officer and, if deemed necessary by the Authorized Officer, by publication in a newspaper of general circulation published in the County of Orange; (c) receipt of a security deposit in an amount established by the Authorized Officer but not more than permitted by State law; (d) preference in the selection of tenants shall be given to those applicants who are residents of, or employed by business concerns located within, the Merged Redevelopment Project Area, to the extent permitted by law; (e) rental of an apartment unit for a family of a household size appropriate to the unit, as set forth in Section 50052.5(h) of the California Health and Safety Code (e.g., "household size appropriate to the unit" shall mean not more than two persons for a one bedroom unit); (f) the Authorized Officer shall verify the income of each prospective tenant by obtaining an income verification certification from the employer of the prospective tenant or from the Social Security Administration and/ or the California Department of Social Services if the prospective tenant receives assistance from such agencies; (g) the Authorized Officer shall obtain a credit report from a commercial credit reporting agency for each prospective tenant; and (h) such other parameters as the Authorized Officer may determine to assure compliance with this Resolution.Section 5. The Authorized Officer is hereby authorized to approve or disapprove rental applications for apartment units at the Property, and, if approved, to take such steps and execute such documents on behalf of the Agency, which in consultation with Agency's General Counsel, he may deem necessary or advisable in order to carry out and implement the purposes of this Resolution and to administer the Agency's obligations, responsibilities,duties and rights and remedies (including the institution of actions in unlawful detainer) to be performed under any rental agreement executed by the Authorized ADOPTED this 24th day of February, 2009.
