RES-10355 Orange Goes Green Program EstablishmentRESOLUTION NO. 10355 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ESTABLISHING THE ORANGE GOES GREEN PROGRAM. WHEREAS, the City of Orange (the City) is a municipal corporation exercising governmental functions and powers and organized and existing under the laws of the State of California; and WHEREAS, the City Council of the City of Orange recognizes the growing community awareness and interest in energy and resource efficiency and "green" practices and building concepts and desires to encourage environmentally responsible practices and development, meaning the siting, site layout, design, construction, and operations of new buildings and the alteration and repair of existing buildings to reduce both direct and indirect environmental consequences associated with construction, retrofitting, use, operation, maintenance, and eventual decommissioning; and WHEREAS, the implementation of resource efficient, sustainable building concepts strategies, and technologies in site planning and building development and in the alteration and repair of existing buildings has been shown to reduce energy usage, water usage, solid waste generation, improve the quantity and quality of urban runoff, improve the indoor environment and air quality for building occupants, and generally reduce overall environmental impacts; and WHEREAS, by reducing energy and resource consumption through the implementation of sustainable building concepts, strategies and technologies, scarce resources are conserved, and operational cost savings over the life of a "green building" can be realized through reduced utility costs, reduced building maintenance costs, reduced environmental consequences associated with the eventual decommissioning of a building, and less demand for City infrastructure expansions and maintenance over time; and WHEREAS, using natural resources in an efficient way and avoiding unnecessary waste, natural resource depletion, and environmental degradation is an important community value and will allow the City to maintain a good quality of life for its residents and businesses now and in the future; and WHEREAS, State and Federal laws either already require or are evolving to require public agencies to address or implement energy and resource efficiency and sustainable planning and site and building design concepts, including, for example, compliance with the California Environmental Quality Act, the National Pollutant Discharge Elimination System, the rules and regulations of the South Coast Air Quality Management District, and compliance with the California Global Warming Solutions Act of 2006 (Division 25.5 commencing with Section 38500 of the California Health and Safety Code) addressing California's greenhouse gas emissions, and the forthcoming amendment to the California Building Code to include green building standards and more stringent energy efficiency requirements; and WHEREAS, the City recognizes that the development community is progressively moving toward sustainable, environmentally responsible building design and construction in order to respond to government regulation as well as market demand in some sectors; and WHEREAS, the City has a role in encouraging cost effective and feasible greener construction and rehabilitation and in setting an example by incorporating resource efficient and sustainable practices into its own operations and maintenance decisions; and WHEREAS, for the above mentioned reasons, the City desires to promote and assist the community in pursuing greener practices and cost effective and feasible greener construction and rehabilitation projects and desires to provide incentives to facilitate private sector energy and resource efficient projects through the implementation of a program that incorporates sustainability strategies while also accommodating desired growth and development within the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: Section 1. The Orange Goes Green program, as more particularly described on Exhibit A attached hereto, is hereby approved. Section 2. The City's Department of Community Development is hereby authorized and directed to act as the lead department for the implementation of the Orange Goes Green program. Section 3. This City Council hereby authorizes and directs the City's Director of Community Development to form an interdepartmental team of representatives from City departments to guide, coordinate and implement the Orange Goes Green program over time and to do any and all things necessary or advisable in order to effectuate the purposes of this Resolution. Section 4. This City Council hereby authorizes and directs staff to begin phased implementation of the Orange Goes Green program, and return to City Council with subsequent actions that are necessary to more specifically implement the program, as well as periodic updates (as necessary) as to program implementation priorities, details, and progress.
