ORD 17-18 Replacing Chapter 5.79 OC Taxi Administration ProgramORDINANCE N0. 17-18 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING TITLE 5 OF THE ORANGE MUNICIPAL CODE REPEALING AND REPLACING CHAPTER 5.79 ADOPTING THE 2019 REGULATIONS OF THE ORANGE COUNTY TAXI ADMINISTRATION PROGRAM. WHEREAS, the State of California adopted new statutes regulating taxicabs; and WHEREAS, these statutes now prohibit cities from regulating taxis unless the taxi company is "substantially located" in the municipality, or unless cities enter into an agreement with a transit agency for administering or regulating taxicabs; and WHEREAS, the Orange County Transit Authority (OCTA) has agreed to be the administrator for Orange County; and WHEREAS, the City of Orange has agreed to enter into a cooperative agreement with OCTA and other cities within Orange County for this administration and regulation; and WHEREAS, in order to carry out this administration, OCTA has prepared regulations which must be adopted by the city and codified into the Orange Municipal Code to give them the force of law NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I: Chapter 5.79 of Title 5, is hereby repealed and replaced by this new Chapter 5.79 as follows: 5.79.010 Orange County Taxi Administration Program Regulations Adopted by Reference. For the purpose of prescribing regulations for the business of providing taxicab transportation service in compliance with the city's requirements under California Government Code Section 53075.5, the following regulations, subject to any future modifications, is hereby adopted: the 2019 Regulations of the Orange County Taxi Administration Program. A copy of the above Regulations will be on file in the office of the City Clerk and are made available for public inspection. SECTION II: Should any section, subsection, subparagraph, clause, or provision of this Ordinance for any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance; it being hereby expressly declared that this Ordinance, and each section, subsection, subparagraph, sentence, clause and phrase hereof would have been prepared, proposed, approved and ratified irrespective of the fact that any one or more sections, subsections, subparagraphs, sentences, clauses or phrases be declared.invalid or unconstitutional. SECTION III: The City Clerk is hereby directed to certify the adoption of this Ordinance and cause the same to be published as required by law.
