AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ORANGE APPROVING ZONE
CHANGE NO. 1287-18, CHANGING THE ZOlYING
DESIGNATION FROM NEIGHBORHOOD NIIXED
USE (NMi TO GENERAL BUSINESS (C-2) ON A
41,672 SQUARE FOOT SITE LOCATED AT 202
SOUTH MAIN STREET.
ZONE CHANGE NO. 1287-18
APPLICANT: Chick-fil-A
WHEREAS, the CiTy Council has authority per Orange Municipal Code (OMC) Section
17.10.20 to take action on Zone Change No. 1287-18; and
WII REAS, Zone Change No. 1287-18 was filed by Chick-fil-A in conjunction with its
project application(the Project) in accordance with the provisions of the OMC; and
WHEREAS, Zone Change No. 1287-18 was processed in the time and manner
prescribed by state and local law; and
WHEREAS, the Planning Commission conducted a duly advertised public hearing on
January 20, 2020, at which time interested persons had an opportunity to testify either in support
of or opposition to the Project, including Zone Change No. 1287-18 and recommended the City
Council approve Zone Change No. 1287-18 and certify and adopt Mitigated Negative
Declazation No. 1858-18, which was prepared to analyze the potentially significant
environmental impacts of the Project, including Zone Change No 1287-18; and
WHEREAS, the CiTy Council conducted a duly advertised public hearing on February
11, 2020, at which time interested persons had an opportunity to testify either in support of or
opposition to the Project, including Zone Change No. 1287-18.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES
ORDAIN AS FOLLOWS:
SECTION I:
The existing zoning of the subject property is depicted on the map attached hereto as
Exhibit "A" and incorporated herein by reference. The Orange Municipal Code is amended in
order to change the zoning classification by amending the zoning on the sites depicted on the
map attached hereto as Exhibit"B"and incorporated herein by reference.
SECTION II:
The proposed zone change described in Section I is related to the public welfaze, required
by Califomia Govemment Code Section 65860 and consistent with Mitigated Negative
Declazation No. 1858-18, and prepazed in accordance with the California Environmental QualiTy
Act (CEQA). The proposed zone change is adequately described and thoroughly analyzed and
reflects the independent judgement and analysis of the City Council for purposes of CEQA.
SECTION III:
The proposed zone change will make the Project zoning consistent with the General Plan
Amendment to change the land use designation for the Project site from Neighborhood Mixed
Use (NMiJ) to General Business (G2) and will make the Project zoning consistent with the
General Commercial Land Use designation established by the General Plan Amendment, as
required by law.
SECTION IV:
Should any section, subsection, clause, or provision of this Ordinance for any reason be
held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the
validity or constitutionality of the remaining portions of this Ordinance; it being hereby
expressly declazed that this Ordinance, and each section, subsection, sentence, clause and phrase
hereof would have been prepazed, proposed, approved and ratified irrespective of the fact that
any one or more sections, subsections, sentences, clauses or phrases be declazed invalid or
unconstitutional.
SECTION V:
A summary of this ordinance shall be published and a certified copy of the full text of
this ordinance shall be posted in the Office of the City Clerk at least 5 days prior to the City
Council meeting at which this ordinance is adopted. A sutnmary of this ordinance shall also be
published once within 15 days after the ordinance's passage in a newspaper of general
circulation, published, and circulated in the City of Orange. The City Clerk shall post in the
Office of the CiTy Clerk a certified copy of the full text of such adopted ordinance along with the
names of those CiTy Councilmembers voting for and against the ordinance in accordance of
Govemment Code Section 36933. This ordinance shall take effect 30 days &om and after the
date of its final passage.
