ORD 06-20 Water Shutoff ProceduresORDINANCE NO. 06-20 AN ORDINANCE OF THE CITY COUNCIL. OF THE CITY OF ORANGE AMENDING SECTION 13.16.080 OF THE ORANGE MUNICIPAL CODE RELATING TO WATER SHUTOFF PROCEDURES. APPLICANT: CITY OF ORANGE WHEREAS, effective Februazy 1, 2020, SB 998, "Water Shutoff Protecrion AcY' (the AcY')requires water providers such as the CiTy of Orange to provide specified protections to those residential water consumers facing discontinuation of water service due to nonpayment; and WH REAS,1he Act requires a written policy on discontinuation including the protections specified in the Act, which policy has been adopted by the City Council; and WHEREAS, the current language of Orange Municipal Code, Chapter 13.16, "Water Rates," Section 13.16.080, requires revision in order to comply with the Act. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES HEREBY ORDAIN AS FOLLOWS: SECTION I: Section 13.16.080.A, "Payment of Chazges — Penalty for Nonpayment," of the Orange Municipal Code is hereby amended in its entirety to read as follows: A. All water chazges aze due and payable in the CiTy's Finance Office in the Civic Center on the date they aze rendered and become delinquent twenty-five (25) days thereafter. If the amount due on any bill for commercial water service is still unpaid by the due date written on the fmal turn off notice (approximately rivo weeks later), and afrer the Ciry has reasonably attempted to notify the commercial consumer of the delinquency, the water shall be shut off and shall remain off until all bills, deposits and service chazges have been paid. For residential water service, if the amount due on the bill is still unpaid by the due date specified, the CiTy shall follow those procedures as set forth in the residential water service shutoffpolicy established by the City Council. SECTION II: Should any section, subsection, clause, or provision of this Ordinance for any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionaliTy shall not affect the validity or constiturionaliTy of the remaining portions of this Ordinance; it being hereby expressly declazed that this Ordinance, and each secfion, subsection, sentence, clause and phrase hereof would have been prepazed,proposed, approved and raUfied irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declazed invalid or unconstitutional. SECTION III: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least fifteen(15)days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after its passage in a newspaper of general circulation in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of the adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933.
