Box 449 Orange, CA 92866-1591 Telephone Number: (714) 744-7220 SPECIAL NOTICE REGARDING CORONAVIRUS (COVID-19) AND ATTENDANCE AT PUBLIC MEETINGS On March 4, 2020, Governor Newsom proclaimed a State of Emergency in California as a result of the threat of COVID-19. On March 17, 2020, Governor Newsom issued Executive Order N-29-20, which allows a local legislative body to hold public meetings via teleconferencing and to make public meetings accessible telephonically or otherwise electronically to all members of the public seeking to observe and to address the local legislative body. Please be advised that some, or all, of the City of Orange Planning Commissioners and staff will participate in meetings via teleconference. In response to the Governor’s Executive Orders, and to ensure the health and safety of our residents by limiting contact that could spread the COVID-19 virus, the public is not permitted to convene in person for this public meeting. Public Participation In place of in-person person attendance, members of the public are encouraged to watch from the safety of their homes in one of the following ways: Spectrum Cable Channel 3 and AT&T U-verse Channel 99, or streamed live and on-demand on the City’s website at www.cityoforange.org. Members of the public can submit their written comments electronically for the Planning Commission’s consideration by emailing them to PCpubliccomment@cityoforange.org with the subject line “Public Comment Item # (insert the item number relevant to the comment) or “Public Comment Non-agenda Item” for general public comments. It is highly recommended that written comments be submitted before 6:30 p.m., prior to the commencement of the meeting. Written comments can also be received during the meeting; however, only those received prior to the call for public comment for each agenda item will be available to the Planning Commission as part of the public record. The public can also record their comments by calling (714) 744-7271 no later than 4:00 p.m. before the meeting. CONSENT CALENDAR: 2.1 APPROVAL OF MINUTES: June 15, 2020 3. NEW HEARINGS: 3.1 CONDITIONAL USE PERMIT NO. 3118-20 – OSTRAKA CHARTER SCHOOL, 4100 E. WALNUT AVENUE. A request for a Conditional Use Permit to allow for an increase in student enrollment for a new charter school for transitional kindergarten through 5th grade at an existing vacant private school campus (former El Dorado Emerson School). The applicant is requesting an increase from the 300 students allowed under Conditional Use Permit No. 1872-90 for the previous school to a new maximum of 360 students. All matters listed under the Consent Calendar are considered to be routine by the Planning Commission and will be enacted by one motion. There will be no separate discussion of said items unless members of the Planning Commission, staff or the public request specific items removed from the Consent Calendar for separate action. Planning Commission Agenda – July 20, 2020 Page 3 of 4 RECOMMENDED ACTION Adopt Planning Commission Resolution No. PC 18-20 entitled: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE APPROVING CONDITIONAL USE PERMIT NO. 3118-20 TO ALLOW A 360- STUDENT CHARTER SCHOOL ON A SITE LOCATED AT 4100 E. WALNUT AVENUE. NOTE: The proposed project is categorically exempt per State CEQA Guidelines Section 15301 (Class 1 - Existing Facilities) because the project consists of the expansion of the number of allowed students. There is no environmental public review required for a Categorical Exemption. 3.2 TENTATIVE TRACT MAP NO. 0050-20, MINOR SITE PLAN REVIEW NO. 1016-20, AND ENVIRONMENTAL REVIEW NO.1871-20. The applicant proposes a Tentative Tract Map to subdivide an approximately 15.4-acre site into 22 single-family residential lots on 10.9 acres and open space dedication of 4.5 acres along the Santiago Creek corridor, located on the south side of Mabury Avenue between Orange Park Boulevard and Cannon Street, north of Santiago Creek. RECOMMENDED ACTION Adopt Planning Commission Resolution No. PC 17-20 entitled: A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE RECOMMENDING CITY COUNCIL APPROVAL OF TENTATIVE TRACT MAP NO. 0050-20, MINOR SITE PLAN REVIEW NO. 1016-20, AND ENVIRONMENTAL REVIEW NO. 1871-20, TO SUBDIVIDE AN APPROXIMATELY 15.4-ACRE SITE INTO 22 SINGLE-FAMILY RESIDENTIAL LOTS ON 10.9 ACRES AND OPEN SPACE DEDICATION OF 4.5 ACRES ALONG THE SANTIAGO CREEK CORRIDOR, LOCATED ON THE SOUTH SIDE OF MABURY AVENUE BETWEEN ORANGE PARK BOULEVARD AND CANNON STREET, NORTH OF SANTIAGO CREEK NOTE: In 2019, The City Council Certified The Trails At Santiago Creek Specific Plan Final Environmental Impact Report (EIR) No. 1957-18 (SCH No. 2017031020) Concurrently with its Approval Of General Plan Amendment No. 2018-0001, Zone Change No. 1286-18, and Development Agreement No. 0005-18. While General Plan Amendment No. 2018-0001 is the subject of a referendum filed with the City and now qualified for the November 2020 ballot, the EIR remains certified and legally valid under CE. Planning Commission Agenda – July 20, 2020 Page 4 of 4 The EIR analyzed the environmental impacts associated with 128 residential units on approximately 40.7 acres south of Santiago Creek, and 68.5 acres of open space, on a 109.2-acre site. One of the four alternatives analyzed in the EIR, “Alternative 1,” involved 40-50 residential units on 15.4 acres north of Santiago Creek, and 16.5 acres of open space, inclusive of the Santiago Creek corridor. The proposed project, which is on the property that was analyzed for residential uses in Alternative 1 of the EIR, results in fewer units, and therefore fewer environmental impacts, compared to both the 128-unit project analyzed in the EIR, and Alternative 1 in the EIR. 4. ADJOURNMENT: The next Regular Planning Commission Meeting will be held on Monday, August 3, 2020, at 7:00 p.m. APPEAL PROCEDURE Any final determination by the Planning Commission may be appealed, and such appeal must be filed within 15 calendar days after the Planning Commission action. This appeal shall be made in written form to the Community Development Department, accompanied by an initial appeal deposit of $1,000.00. The City Clerk, upon filing of said appeal, will set petition for public hearing before the City Council at the earliest date. All owners of property located within 300 feet of the project site will be notified by the City Clerk of said hearing. For additional information, please call (714) 744 -7220.
