A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE APPROVING LOT LINE
ADJUSTMENT 2009-01 ADJUSTING LOT
LINES BETWEEN CERTAIN REAL
PROPERTIES LOCATED AT 145 AND 189 SOUTH
WATER STREET (THE CITY OF ORANGE WATER
YARD)IN THE CITY OF ORANGE, COUNTY OF
ORANGE,STATE OF
CALIFORNIA.WHEREAS, Section 66412 (d) of the Subdivision Map Act (hereinafter referred
to as the Act) provides for the City Council to approve lot line adjustments by resolution
where the land taken from one parcel is added to an adjacent parcel and where a greater number
of parcels than originally existed is not thereby created;
and WHEREAS, the City Council has enacted Orange Municipal Code Chapter16.
32,which provide for the procedures to be followed for the approval of lot line
adjustments pursuant to the Act;
and WHEREAS, the Subdivision Section of the Department of Public Works and
the Staff Review Committee have reviewed and recommended approval of Lot Line
Adjustment 2009-01 and have made a finding that the real property situated at 145 and 189
Souih Water Street (The City of Orange Water Yard) in the City of Orange, further described as
parcels 1 and 2 in Exhibit A, attached hereto and graphically depicted on the map attached '
Hereto as Exhibit B, complies with the provisions of the Act and all applicable City
of Orange ordinances and regulations, including the requirements for building
sites; and WHEREAS, the Subdivision Section of the Public Works Department and
the Staff Review Committee have made the
following findings:1. That the proposal is eligible for processing as a lot line adjustment
pursuant to Section 66412 of the
Act; and 2. That the requirements of the California Environmental
Quality Act hereinafter referred to as CEQA) have been met, as further
described in Resolution No. 10427, incorporated as if fully set forth
herein; and 3. That the proposal is consistent with the City of Orange General
Plan; and 4. That the resultant parcels will meet the requirements of the City
of Orange
Zoning Code.NOW, THEREFORE, BE IT RESOLVED that the City Council hereby
adopts the aforementioned
BE IT FURTHER RESOLVED that Lot Line Adjustment 2009-01, as shown
on Exhibits A and B attached to this Resolution, are hereby approved, and a deed
establishing title in conformity with resulting said parcel be executed and recorded;
and BE IT FURTHER RESOLVED that the City Clerk of the City of Orange is
hereby authorized and directed to cause this Resolution to be recorded in the Office of the
Orange County
